I believe divorce is separate to financial agreement. So you can get divorced and decide on assets etc after. You can if you both agree to that, but you pay may have to pay tax on it. Are you sure you paid the IHS for each of your three children; when their visas were only valid for 5 months?? The OP would have applied for a 2.5 year visa for each child, so yes IHS would have been payable as that is what was applied for. The fact that the visa granted was issued based on the OPs...

The UK expects both parents to keep their child, even if they don't want to see that child. The courts take a dim view if they don't pay.

The maintenance calculation is the minimum they have to pay. Many parents choose to pay more than that minimum amount.

To get back on the 5 year route, you have to apply again, meeting all the requirements with evidence. Her 5 year ILR clock will start again from zero if granted.
