I am regularly defending such refusals in the courts.

Send me a copy of the refusal and I will see what can be done about that.

As for your family passports. The UK BA is usually only sending them to the port of exit provided you sent them copies of your flight tickets a few weeks in advance.

Re: Will I loose ILR if I only return to UK for short period

You may, especially if you would be applying to return to the UK as a Returning Resident. I have seen such a refusal just a week a so ago. The chap wrote in his RR application (prepared by his secretary) that he was return to the UK to check his flat... Probably he will lose his appeal now, as it wa...

Re: URGENT: Withdrawal of Appeal as a prerequisite to issue

Hello: (1) Is this process correct ? Can the UKBA withhold issuing the first visa (RR) if he does not withdraw his second appeal (EDP) ? - I have seen this before. The HC is confused because your father lodged a 2nd application while appealing the 1st refusal of the 1st application. The HC is now in...

We have set slots as well as are normally able to get further slots 5 days a week, but we are in Birmingham, therefore we are accredited with PEO Birmingham.

Mind, though, that we are a private legal firm and that we do not sell slots.

Closure of Immigration Advisory Service (IAS)

It has been announced today that the Immigration Advisory Service (IAS) went into administration: http://www.legalservices.gov.uk/civil/cls_news_12838.asp 2 weeks ago I was in the court (IAC) and I happen to see some 4 IAS appeals listed in one of the court rooms on that day. IAS had quite a number ...

Re: EEA4 fast processing times or wishful thinking

About 3-4 months on average, on the basis of the clients' applications. We normally receive Certificates of Applications within 1-3 weeks. In some cases we had to ask for the CoAs to be re-sent. Tony Dalton, a Chief Caseworker at the Nationality and European Casework was quite helpful in the past, i...

Did not register under WRS ? May not be able to apply for PR

Came across an interesting letter from the UK BA. Briefly, the Worker Registration Scheme (WRS) will be abolished on the 30th April 2011. Unfortunately, those A8 EU nationals from EU, who joined EU in May 2004 had to be registered under the Worker Registration Scheme (WRS) in order to be eligible fo...

No, you cannot.

2 options:

- if you still have a valid visa - withdraw your application, do the business in your country, return and re-apply

- if your visa has already expired, but you do need to go, withdraw the application, do your business and apply for an EEA Family Permit from your country

This is because they are not generally accepting any bookings at PEOs between 23-12-2010 and 04-01-2011.

This also includes law firms, as we got a letter from them a few weeks ago informing us that they would be not accepting legal reps for the above period, too.

Treasury solicitors confirmed on 20 July that the Secretary of State will not be appealling Secretary of State for the Home Department v Pankina [2010] EWCA Civ 719 to the Supreme Court. Indeed nice PEO, normally there on Fridays. On average if there were no gaps, problems etc they grant ILR on the basis of 10 years in about 2 hours. Some hard cases, when I feel it, I advise to obtain a copy of a file under FOI/SAR. To obtain a FOI/SAR costs £10 and takes about 2 months. What else ...

Bombarding may help, although if everyone does it, the system will be clogged up. Our average time for eea2 is 1.5 months, eea1 - around 4 weeks. I do remember some cases from last years, when indeed the waiting time was in excess of 6 months. The problem would be normally solved after a quick conve...

Our average case consideration time was 3 weeks for naturalization based on marriage and WP. Max - 3 months for the case when there was a number of category switching.

My guess would be FLRM. The reason is that they cannot apply for anything in line with you, so they have to wait for you. You will be, hopefully, Settled with ILR. In this case they should be applying with FLRM. Wht not with SETM - they should have been dependants of someone who is British or Settle...

If no removal orders (IS151A/D) were made, you could have your ILR granted, provied you meet all therequirements of the Rules.
