Thanks... Yes, I'm sure I can get a letter confirming the travel and business reasons.

I will try and hope HO considers it. Think that's all I could do

It is totally based on lawful residence not the type of visa. Only deportation during 10 years and 6+ months absence from uk in one year affect ilr clock. The problem with that is because EU Immigration rules the passport doesn't have any entry stamps so its impossible for HO to tell if the applica...

EEA2 and ILR 10 years

Hi guys, I have a question scenario is 4yr x Student 2yr x PSW 2yr x Tier 1 (General) 2yr x EEA2 total 10 years. Can i apply for ILR 10 years under UK rules or wait another 3 years to get a PR under EEA rules. I have been reading this on UKBA site which is quite confusing http://www.ukba.homeoffice....

Under eu law it does not matter when after wedding you apply eea2 permit as you can do it any time even your visa expired as long as your eea spouse is excercising eu treaty rights. But now you talking about self-emplyoment. Before you said that your eea national wife is doing full time employment....

I doubt they can just refuse an application when its done 2 weeks after getting married. If UKBA thinks its a marriage of convenience then they have to provide concrete evidence and timing is just not it.

I think they have refused it on some other silly ground (as they do).

Thanks a lot for your reply. This is such a relief. Yes, I know I would get PR sooner if I stay under Tier 1 but to be honest not too fussed about getting a PR. We travel a lot so RC will allow me to travel with my wife freely (without applying for a visa every time) I think I just need to make sure...
