As far as I can tell, I don't see any reason why you can't have EEA applications in both countries. Shouldn't be a problem.

The UKBA site, I can guess, says that if you are subject to immigration control, which you are, you need to get a CoA for getting married. Being already resident in the UK doesn't mean a thing.

To me it clearly looks like a marriage of convenience, just from the fact that you are an overstayer. No question of human rights here either. You should pray the Home Office would see it different.
