Human rights. My reasons for refusal were very different to yours. We met all requirements of Appendix FM but my spouse had a poor immigration history.

Hope you’re well.

I think you will be able to overturn this at a hearing provided you gave good representation.

My husbands visa was also refused under 320(11) in October 2019. We just had our hearing last month and waiting for the outcome.

Yes, the only chance you have is before a judge.
A judge will decide to see if discretion has been applied appropriately, the time between the offences and now, family life with your partner etc

Sorry, you said judge. It will only go before a judge at your hearing. Before then it will go back to the ECM and ask them to review the decision again based on your appeal documents. Very unlikely I’m afraid. 320(11) has rarely been overturned before a hearing. However, never say never.

Appeals generally take a long time but I think mine was 14 months due to Covid and the lockdown. The courts aren’t affected by this most recent lockdown as they have now adapted their processes to be able to deal with such since last year!
