Re: Spouse visa - couple of questions

1. You could likely explain it exactly like you have here: how long you've known each other and when you started pursuing a relationship. Can't recall the exact form details but I believe there are actually separate boxes for each of those and it is not uncommon for people who previously knew each o...

Re: Seperating from husband need advice

I doubt he would be willing to include such a statement with his application. It would up to him to demonstrate ongoing parental responsibility in order to try and get this visa, not for you to try and prove the opposite. Deciding whether an applicant meets the requirements is the responsibility of ...

Brill.

What is the name of this particular application/visa?

Thanks
Informally it would be called a spouse visa. More formally it would be entry clearance as a partner of a British citizen.

Re: FLRM financial requirement if employed then self employed

1 - Yes. Gap isn't a problem if you are providing 12 months of pay slips (Category B) but wouldn't work well under Category A (6 months or more with current employer). 2 - Yes. See table on page 18 of guidance at https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_d...

Yes, no issue I can think of applying with super priority service provided you have all of the required documentation for the application.

Re: Spouse Visa FLR M

If the application is a visa for your wife, it is likely only her that would need to be in the UK at the time of application provided you were still considered 'settled' in the UK. However, if she were to leave the UK after applying her application would be considered withdrawn.

Re: FLR M - Overstayer - Income

For an umbrella company Category A or B would probably be most applicable depending on length of time with current employer and salaried vs. variable income. FLR(M) is further leave to remain in the spouse category (i.e. for someone already legally in the UK). Applications from outside the UK can be...

Re: Will My Application Be Successful?

The wording of the guidance document suggests bank statements for the previous 12 months showing the income paid into the account. Any money being going out of the account the benefits are being paid into would not affect the application, they are only interested in confirming the income.

Here is the guidance on what does and does not count as public funds: https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/772305/Public_funds_v14.0ext.pdf If government funded, there's a good chance this would fall under the category of state-funded school...

Re: Cash saving route

Will they check your savings according to last six months currency rate? I honestly don't know and wouldn't want to guess at what the officer reviewing the application would do. They are required to follow the guidance. The guidance says the value of the cash savings is determined by the exchange r...

Re: does free part time college course counts as claiming benefit which would affect spouse visa?

If it's funded by the government it's probably worth confirming the eligibility requirements with the college as it's very possible these courses would not be available for free to non-EEA students or those that don't meet a minimum UK residence requirement and that information just isn't included i...

Re: Will My Application Be Successful?

A British child is exempt from the financial requirements for a spouse visa where the standard financial requirements are being met (i.e. £18,600 per year income plus more for each non-British child, or having sufficient cash savings). For the adequate maintenance route, the financial requirements s...

Re: Will My Application Be Successful?

Sorry, that's not entirely correct as it would be the case for a standard application based on earnings. For the adequate maintenance route, your income is compared to what an equivalent British family would receive. An equivalent British family with children would have increased income by having th...

You can claim whatever benefits you are entitled to as a British citizen without an impact on your wife's visa (including child tax credits).

Adding names to utility bills now will only help if you're short an item of recent correspondence. It all kind of...

Not being able to demonstrate living together and meeting this requirement is a problem. The checklist in the online application form specifies the num...

Yes, you will have to show you can meet the financial and accommodation requirements at each stage as the intent is typically to demonstrate that the non-British citizen can be supported without reliance on public funds. That said, once your wife has a visa, any income she earns in the UK can also b...
