Re: Cash saving route

I want to ask that my marriage certificate and rent agreements are bigger than A4 size paper if I'll do them on A4 size then they'll not be original and originals are required for Scanning so what's better thing to do I would provide the originals for scanning. Paper size is rather non-standard acr...

Re: Spouse visa refused 320(11)

You are probably better off speaking to a lawyer regarding these issues and your potential chances of success in an appeal. Even if they were willing to ignore the overstaying for more than 5 years, having provided false documentation and made false representations in previous applications are reaso...

Re: Uk spouse visa 28 day rule

General advice would be not to include anything date after the application submission date as it won't likely be considered. You would be expected to meet any requirements prior to submitting an application.

Re: Spouse Visa and Unpaid Leave re Financial Requirement

I got approved and honestly I didn't even apply under the right category. Dangerous manoeuvre. I think the correct advice you have already received which exactly matches with this success experience now might put your mind on ease. Agreed, you have no problems meeting the requirement and hopefully ...

Re: Spouse Visa and Unpaid Leave re Financial Requirement

The lowest month obstacle only applies to Category A as they use the lowest month's income to calculate an equivalent annual figure (lowest month's income multiplied by 12). Category B is based on current salary (at the time of application) and total income in the previous 12 months so the lowest mo...

Re: Spouse Visa - Proof of Relationship

1) Yes, you will have to provide evidence of a genuine and subsisting relationship. 2) If you are married, there is no requirement to have lived together so you will not have to provide proof of this for the first spouse visa (Entry Clearance). When you go to apply for an extension later (Further Le...

Re: Spouse Visa and Unpaid Leave re Financial Requirement

Unpaid leave specifically (it mentions Unpaid Parental, Maternity and Sick leave but not unpaid holiday) There isn't anything on unpaid leave for holidays. If it's not a type of unpaid leave specified (i.e. maternity, paternity, adoption, parental, or sick leave), it will count as breaking the cont...

Re: Spouse Visa and Unpaid Leave re Financial Requirement

For Category B you can still use salaried employment, you're just using the category because the income is variable in the previous 6 months due to the leave. You only have to demonstrate that your current salaried employment meets the financial requirement and that you have earned sufficient income...

Re: Coming back to UK before BRP expiry date

One last thing, I received dividend payments in two months, shall I just include a statement from those two periods instead of a full 12 months. Rules ask for 12 months statement (full financial year) for salary but they do not seem to ask full financial year statements for dividend payments. Do yo...

You will note from the link Jaune08 included that you cannot apply for a visa as the parent of a child in the UK if you are eligible to apply as a partner of a British citizen. Additionally, in order to qualify as a parent your child must be living in the UK (not clear from your post where your son ...

Just because he is exempt from meeting the minimum income requirement doesn't mean there is no financial requirement to meet; he still has to meet the requirement of "adequate maintenance". Re: Coming back to UK before BRP expiry date

With regards to dividends, the guidance and the immigration rules (Appendix FM-SE) are worded such that if you receive them, you have to provide the listed evidence. There is nothing about omitting them even if you aren't relying on them to meet the financial requirements. I have no experience in us...

As long as the information from your bank statements aligns with what is on your payslips, you shouldn't have any issues (e.g. the amount your payslip says were supposed to be paid was deposited into your bank account, even if it's cash). The February payment of December and January wages is the mos...

As long as you provide documents from at least 3 different sources, using the same source for bills addressed to each of you individually at the same address spread over the past couple years is not a problem. I have been away for 1.5 years. Is that relevant in this case? just wondering...
What seagul said was why I asked. Not relevant in this case obviously but could be for some who aren't aware of the various quirks in the rules for ILR.

You may be able to purchase additional premium services by logging back into the UKVCAS (Sopra Steria) website but I'm not sure if you can change to a super priority service or not but should be quick to check by going into the website. From the timeline thread, UKVI have recently been relatively go...
