From 4 Oct 2011 till date it is too much time to issue a formal refusal letter as no other issue was involved. Consider sending a politely worded complaint through post (instead of email) regarding the standard of service at PEO - by using the form provided by UKBA. http://www.ukba.homeoffice.gov.uk...

Instead of paying premium fee for FLR Tier 1 (HSMP) as well as fee of solicitor it would be better to send postal application. Postal FLR Tier 1 (HSMP) is normally decided within 4 weeks. If you applied for Tier 1 in India in June 2009 under Para 44 of HSMP JR Policy Document of 2008 than all the period between two leave spent in India would be treated as leave towards ILR as per Para 50(b). Hence you have continuous stay in UK for ILR in 2012.

What is the validity date of your current visa?
If they give you extension to aggregate absences than you would be lucky one - may be the first instance on this board.

UKBA website says that PEO same day service is not available for HSMP extesion but two such examples are available and one of them had sought and got second extension:

Advice given is bad in law as well as on facts. Just ignore that. There was no need of calling UKBA when precedents are available on this forum.

Fill FLR Tier 1 (HSMP) and send that.

There are so many examples of getting second extension of HSMP.

Send your HSMP approval letter with above form.

Yes. May not work but is wroth trying in March 2012 instead of waiting for Feb.2015.

Even as suggested by you JR is also wroth trying - he can withdraw that if it goes to hearing to keep the cost at minimum. As per your assessment UKBA would concede at an early stage.

Considering your thinking your course of action can be:

1. Apply for extension and later
2. Apply for ILR after 4 months of extension ( after aggregating absence in question)

Meanwhile reconsideration can be tried.

Sorry to hear that. There is no consistency in UKBA on this issue. There are instances on this board where business related absences of more than 90 days at a time were disregarded. As per your posts you applied ILR on 7 Sep 2011 at PEO and your application was sent to refusal team due to a longer absence. On refusal you filed appeal and hearing was scheduled around 10 th Nov.

Absences is a major issue in some of the cases and a routine type of employer letter just mentioning the dates is not sufficient.
I think that earlier template made sticky needs replacement with your one.
