Even though you are retaining rights, the Home Office's interpretation of the law is that you are technically not a family member of an EEA national anymore- it's a bit of a grey area, but under the strict definition of family member, you would happen not to be one. Morpheo, you are not required under the EU law to provide proof that the EU national is still hanging around.

Or why don't you do it my way and provide a date of departure. Let them prove that your partner is in the country if they know!

archigabe, the EC 562/2002 is a totally different issue and is only a part of the documents that will allow travel to Schengenland. The 'Residence Card of family member of EEA national' falls outside it's scope.

I will explain it all when I get the time.
