Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

Do they actually check with foreign authorities? And if so, what are they checking? Are you100% sure this happens? or is this a myth.... I haven't seen anything in the FOIs on this nor on any thread Re national security etc - that I have heard of - cases where for example the minister was looking in...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

The FOI is made with the DOJ In the form you ask for: all pertaining information and documentation held on the citizenship application, and provide them with the application # You don't need to separately ask for GNIB records nor contact that office, if this is for a citizenship application. The DOJ...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

Question for anyone who have completed or initiated a JR: did you have to physically go in to sign the paperwork for the court filings etc? Or is there an option to avoid the physical contact and the signings/appearances virtually?

Re: Two years waiting

The JR is the process to get the decision via the courts. If you've been waiting for 2+ years and there is nothing on your file to justify the delay (and you've done a FOI to confirm) then you qualify for a JR. There is a whole thread on this here: https://www.immigrationboards.com/ireland/foi-and-a...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

The process to qualify you to even file a JR can take 6 months (1. you need the FOI, which can take 2 months, 2. you need a lawyer to send 1-2 letters to the department to give them a chance to rectify the situation - each letter gives the dept c.6 weeks to respond). From the time your lawyer files ...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

Sadly it seems like (i suspect) why the department have been saying they are prioritizing the cases waiting for 2 years or more --- there are so many people going via JR, it's become costly for them, and sadly it seems to be the way to secure a decision. The JR proceedings are apparently clearing up...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

In terms of finding a lawyer, whilst you can't say the name of the lawyer here, here is some guidance on how to find a lawyer: 1. Google something like "Dublin Immigration Solicitor" 2. Look at the google reviews of the firms and read through it. 3. Call/email a handful of them, to see their pricing...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

The JR proceedings are apparently clearing up really quickly now - 1-2 weeks people are getting a decision once JR paperwork filed. The judge handling these cases is not happy that these naturalisation cases are clogging her court room, and that's apparently good as she's in favour of approving thes...

Re: Getting Divorced While Naturalization in Progress

Unless anything is official don't jump the gun and get sound legal advice if you need to. As I understand it a separation & a divorce takes a very long time in Ireland. To make a new citizenship application (i.e. 5 year) and cancel the old one is not easy. There is a forum about this and it's typica...

Re: FOI for citizenship application

The same is true for a citizenship application made based on marriage. If you request an FOI, you need a letter from your spouse that says they're ok with the release of the info. You make a request on behalf of your child. Your will need to provide your child’s ID as part of the application. Each F...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

Be prepared to wait even 8 weeks in total. There are a lot of delays. But it's just a matter of time! I had applied to get a copy of my record under FOI Act. I applied on 15th Feb. I was supposed to get my record by 15th March. Instead I had got a letter stating this: "Time Extension The Deciding Of...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

The department is saying that it hopes to clear the backlog for anyone waiting 2+years* by June, and they will contact such applicants directly by the end of this month - anyone receive a letter by the INIS yet? It's progress, but i'm skeptical if they will actually follow through with this. https:/...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

How do you even know who his lawyer? We can't publish details like that on this forum. And how is this the fault of his lawyer? Based on what Paddy is saying his lawyer did all the right steps, and it seems like the department is showing how poorly they're operating. Speaking of actual legal advice,...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

Sorry to hear that. Has your lawyer advised why that is? It's so odd as it's a court order. Is it as a result of the pandemic? What are your options now legally speaking? [Based on legal advice] The current situation at the department is there are a lot of delays. A straightforward application can t...

Re: Citizenship delays: FOI and an application for an Order for Mandamus via the High Courts

[Based on legal advice] The current situation at the department is there are a lot of delays. A straightforward application can take 18 months. (Apparently nationalities from Iraq, Afghanistan, Syria, Pakistan are known to wait longer). There was already a backlog ahead of the 2019 court challenge, ...

How much are your legal fees? and how long ago did you submit your citizenship application? Thanks for sharing. The 11 people they got an approval? And have you started your JR? No problem! On a related note: I've noticed people have different theories about how long one should wait before going thr...
