And you need to quote me correctly: I clearly said "sound like someone who is trying to cheat". This was merely a hint to you to realise how your wording may come across to those who read this thread. Please, do not put things into my mouth that I have never said.

No need to be rude. I know the legal situation. The question is whether, there is a control to find out otherwise, which i dont think there is. I am not trying to be rude here but with a question like this you simply sound like someone who is trying to cheat. You may want to consider your wording t...

my understanding is once the resident card is endorsed, would it be an issue whether i am here or there in malta? The question is not what documents your wife holds but it all depends on you, the EEA national, exercising treaty rights according to the EEA regulations. The legal situation has been e...

Basically the UK route costs (quite some) money and you would have to establish yourself (alone) in the UK first. The EEA route (under the Surinder Singh and Eind rulings) may need some explaining to the embassy staff in Paris unless your spouse happens to be a non-visa national and you could try to...

A British citizen would have had to make use of free movement him/herself (typically by moving to another member state) to be covered by the Directive and thus access to EEA family permits. But even if so, I think the extended family member would be expected to have resided with the EEA national and...

The UKBA staff would have seen that in their database anyway.

I felt I should comment on that in case other interested people in similar situations are seeking for a solution to that problem.

I suppose you have already seen this UKBA announcement . As I read it, the problem may be that you will have to show that you would have to leave the UK if the carer cannot stay with you. That seems a very tough criterion to me. You better discuss this with your lawyer as this is all new and nobody ...

How did she enter the UK? Alone as a visitor or together with her husband?

Your appeal should be first reviewed by the ECM which could take days or maybe a few weeks. If the ECM does not overturn the initial decision the appeal would go to the UK and that could set you back for months. You should certainly keep yourself updated but too many calls or email won't do any good...

Which would apply to the OP only if he was a permanent resident and thus had 'settled' status. The possible advantage would be that ILR could be applied for after 2 years and citizenship is possible after 3 years. Since the OP is Swedish, the spouse could apply for British citizenship 5 years after...

The differences between a spouse visa and Family Permit ( FP)is an £810 fee for the spouse visa. Also, the spouse visa is under UK immigration rules. Re: Spouse Visa - Advice and some questions about my case

Finally, this is what worries me most: my wife spent a month and a half in the UK, she had to leave because after visiting my family in Spain, on our return to the UK an Immigration Officer wasn't convinced of what she told him, almost refused her to enter the UK. He finally let her in but shortene...

You are obviously not applying for a "Spouse Visa" but rather for an EEA family permit (that distinction is very important). As you are in the UK already, presumably longer than three months, you will have to show that you are exercising your treaty rights. Self-employment is just as fine as being a...
