Old passports are typically rendered invalid through physical means. It is interesting that the Albanians didn't do that. I would expect the UKBA to have a database, that is your failed application may show up at the border. Generally, the non-EEA nationality family member does not become "illegal" ...

The decision was obviously made under EEA regulations. The only argument why the application has been refused is that it apparently has been tampered with, is thus invalid and your wife's identity could not be established. The question is if they expect or will get feedback from the Albanian authori...

Just as an aside but why where you not allowed to open a bank account? Do you actually mean that no bank accepted you? If the latter, I think you could still open a joint bank account with your mother.

What type of visa will the wife be applying for? Does your cousin plan to extend his stay?

I can imagine that the expiring visa may cast doubt on their intent to leave Germany again.

Just to confirm: the problem that the UKBA have with the ID card is that it does not literally state 'Nationality: Polish' (or its Polish equivalent)?

You really should have infomred about this crucial piece of information when you started this thread to avoid this unnecessary confusion.

It seems odd that they would believe you can be treated as an extended family member simply because you have entered the UK without the EEA FP.

@86ti - whatever!! move on!. Sure. If I choose so. @ Directive - Think you are mistaken, loophole is around the fact that once a resident visa is issued, i dont think there is a control around the fact that checks your eligibility for being resident /not resident. Unfortunately, you are the one who...

And you need to quote me correctly: I clearly said "sound like someone who is trying to cheat". This was merely a hint to you to realise how your wording may come across to those who read this thread. Please, do not put things into my mouth that I have never said.

No need to be rude. I know the legal situation. The question is whether, there is a control to find out otherwise, which i dont think there is. I am not trying to be rude here but with a question like this you simply sound like someone who is trying to cheat. You may want to consider your wording t...

my understanding is once the resident card is endorsed, would it be an issue whether i am here or there in malta? Basically the UK route costs (quite some) money and you would have to establish yourself (alone) in the UK first. The EEA route (under the Surinder Singh and Eind rulings) may need some explaining to the embassy staff in Paris unless your spouse happens to be a non-visa national and you could try to...

A British citizen would have had to make use of free movement him/herself (typically by moving to another member state) to be covered by the Directive and thus access to EEA family permits. But even if so, I think the extended family member would be expected to have resided with the EEA national and...

I suppose you have already seen this UKBA announcement . As I read it, the problem may be that you will have to show that you would have to leave the UK if the carer cannot stay with you. Your appeal should be first reviewed by the ECM which could take days or maybe a few weeks. If the ECM does not overturn the initial decision the appeal would go to the UK and that could set you back for months. You should certainly keep yourself updated but too many calls or email won't do any good...
