Re: MN1 section 3(1) application refused

1. She would be an overstayer . 2. She may apply for SET(F). Thanks Vinny for the reply and relevant links. Is it correct in interpreting that Section 3C will not be triggered if a decision was not made by the time her current visa runs out? (I am not sure if applying for naturalization will be tre...

Re: MN1 section 3(1) application refused

Thanks for the replies. I have a further query with this topic and it would be great if someone could please help me. My daughter (2.5 years old - born outside UK) has completed 1 year in the UK now. Her dependent of a settled person visa runs out in Aug 2016. Since I need to travel with her in Nov,...

Re: MN1 section 3(1) application refused

Section 55 Borders, Citizenship and Immigration Act 2009 Imposes a statutory obligation for the decision maker to consider the best interest of the children in such cases. Where one parent is settled and the other is British it appears contrary to section 55 not to allow such an application, despit...

Re: MN1 section 3(1) application refused

Thanks for your reply. The only reason I thought of this option was to avoid the fee for ILR for my daughter. I mean I was thinking like, if the rules are clear and my daughter is be eligible for BC straightaway, why I should I contribute the ILR fee to the homeoffice?

My daughter who is 2 years old and who is living in the UK for the last 8 months is on Dependent of Settled person visa running out after mid-2016. My question is if I apply for her naturalization now, is there a chanc...

Re: English Requirement for NATURALISATION

The university and the degree is still listed in the calculator. I think the problem lies in the first question, if you choose Tier 2, then you wont see points for degree, and if you choose Tier 1, you will see points. Don't know the reason behind it, but I saw it in another thread, where someone i...

Re: English Requirement for NATURALISATION

Yes, its listed, and I used the same PBS calculator successfully for my ILR application last year. What I am not able to get is the points for Degree separately. I can see points for overall, salary, maintenance, english language, but not degree. I am not sure in this case as I can see my degree lis...

Re: English Requirement for NATURALISATION

From the point based calculator, I can see I get 30 points for the degree and 10 points for English language. I hope this should meet the requirement for knowledge of English language. Thanks, alladin Hi, Did you get points for degree and English language separately? because when I tried the Calcul...

Hi, I have taken ILR on Feb,2013 (hsmp+Tier1 5 year route) and was planning for taking citizenship. I have a query about english requirement. Re: PBS Dependent

Thank you for pointing this out. I think the important point is that the dependant has "continuous leave". But during the continuous leave, the dependant need not spend the entire time in the UK. It's also unclear , if the continuous leave is broken as a result of applying for entry clearance. I am...

The type of Visa is stated as VISA SPOUCE/CP - Spouse of Mr.xxxx. Valid from 03/12/2013 - 03/09/2016. We provided evidence of a TB test conducte...

Re: ILR for wife who was on Tier 1 dependent visa

My views on your case remains unchanged. Thanks Obie. I received advice from an immigration lawyer that this application should be valid and could be successful. Re: ILR for wife who was on Tier 1 dependent visa

If her T1 dep visa expired, it expired and the time spent in the UK won't count towards her ILR as she applied for new entry clearance on VAF4A and a different set of rules. She will have to apply for an extension on FLR(M) in June 2016 and will be granted another visa for a further 2.5 years befor...

ILR for wife who was on Tier 1 dependent visa

Hello, This query is for my wife's eligibility for ILR. (I was granted ILR on Feb 2013) My wife entered as Tier 1 Dep on Oct, 2010 and was in the UK till Nov, 2012 after which she had to go to India for delivery. Her visa was valid till Mar, 2013.
