It's a bit of a vague query but here goes. Your child will not be British unless it is born after you have been granted settlement (assuming you or your wife don't alreadyhave some residual right of citizenship). You are generally not entitled to public funds. However there is a list of countries th...

Trust me, I'm right behind you on this one. You make some interesting points as well and as you've pointed out, the Home Office are in a bit of a kerfuffle over your secret weapon  . I can't see them continuing with a scheme for which they (shock, horror ) can't charge for and for which ...

Sorry ginoT, but I think you're being overly optimistic with the potential JR. You've said yourself that the application for the COA was submitted late because you were waiting for guidance from UKBA. The Forester ruling related to an issue with the applicant's bounced cheque for an in-time applicat...

I think ECOs are just as confused as everyone else by some of the tier requirements. If you're absolutely sure that your college is the same, simply send the documentary evidence pointing out that the college has A listing as an approved sponsor and request an Administrative Review. If the ECM finds...

blessedlady,

You've given completely opposite statements in your two posts. Firstly you state that you've left the UK and were refused. Secondly you state that you were refused in the UK and have not left.

Can you explain your position a bit more clearly?

320(11) is the hurdle that most overstayers in your position need to get past before you can benefit from the concession.

What exactly did the ECO say in relation to the reasons for refusal?

You're quite right about the DV fee, greenie (a misnomer if there ever was one! ). My view is if the exemption is there - go for it. (It's not failed yet.) But I suspect the Corporate Bank of UKBA will be coming down on that policy harder now it's got all these customer charters and service p...

Oglox, You've more or less researched your own questions and you've had the answers from more than one expert here. It's all coming out the same way. Normally your wife would not be able to switch. If she came in on a marriage visit visa then she has to return home and reapply. It doesn't matter tha...

There was never any fee for the British partner; the COA served as a joint application. The fee has been suspended since 9 April 2009. A couple of years ago when the Home office started informing students about the 5 year requirement for settlement, it confused a lot of students. If the marriage has broken up as a result of domestic violence (either from her husband or from another of his family members), she will need to provide evidence. A police or GP report, an official letter from the safe house, evidence of counselling or other related statutory support should suffice....

EU rules don't apply here? I thought we signed up to the European Human Rights treaty? Surely they should warn people that if the...

Which means applying for FLR. I'm surprised they even had the practice of refunding the difference between SET(M) and FLR(M). Such generosity is totally out of character for the Home Office. I always thought such applicants were living on borrowed time. I wonder what else they'll amend next. £50.0...
