You're not understanding my post (Paperpusher has explained what I meant now). If you met the rules now, but was asking for the visa to start in the future then that would be post-dating, but you are not...

Think you are taking a risk as you aren't asking for the visa to be post-dated as such (which would be something normal to ask for). I guess if the eco is in a very happy mood you may get away with it. The risk is they will give your wife a 2 year spouse visa instead, which you might not be happy wi...

Re: Inequality between British nationals and those naturalis

Hopefully I have this mixed up somewhere as I'd really love to get my wife naturalised as soon as possible. Frustrating when a couple of my friends who aren't even British yet were able to bring their new wives over to ILR immediately. ILR isn't the same as naturalisation, and your wife can be natu...

Re: Council tax needed for ILR?

Can anyone tell me if we have to be paying council tax to get ILR? Our landlord is paying it for us so we do not have anything under our name. Does the home office do checks to see if you are paying? If you are not convicted for not paying council tax, you are fine. It doesn't matter who pays the c...

What I've been wondering is why the HO spent so much time looking into your application if you didn't change jobs until after you applied? Did they find out (if so how?) or was there other issues with your application?

Thank you vinny, i may have a window, as long as i submit my paperwork properly, will she now have to do an english test with the new rules? The English test pre-entry into the UK has not been implemented yet, and I don't believe any dates are known for exactly when it will be. She will though have...

Surely though by doing that you are claiming that your son has dual citizenship, which India does not allow. Will the Indian government (immigration officers, etc) realise how the Right of Abode has been obtained?

The requirements of a referee for a naturalisation application is: - they have known the applicant personally for more than 3 years; - they are willing to give full details of their knowledge of the applicant; (This is different to the requirement of a person who countersigns passport applications)...

I agree with djb. Even unpaid Charity work is considered as part of the working allowance. In this case though it's worse than unpaid, it's cash in hand and therefore avoiding tax. Still wondering why the restaurant/accountant had the NI number in the first place if they didn't think they were were...

As far as I know every UK resident who has no restriction on their stay in the UK who has children under a certain age is entitled to claim child benefit, so why should you not mention it if it strengthens your case by increasing your income? With normal spouse visas (which are for 27 month) if you ...

Basically you've got a year to get jobs in similar locations so you can live together as a couple. Now you've got your passports back you want to find jobs as quick as possible so you can spend as much of that year together. As I guess they've given you the equivalent of 1 years FLR, you will have t...

You need to be very careful how you handle the situation as regardless of what your dad’s best friend says, what you did for him was work (paid directly or in kind). Many restaurants, etc have been prosecuted for having people not eligible to work (on visit visas, etc) helping out as a way of 'tha...

The fact that your children have British passports doesn't mean they have to live in the UK. Does make it slightly easier if they don't need settlement visas, but regardless of whether they need visas or not if you are trying to get a settlement visa for one member of your family (ie your wife) you ...

Children having British passports does not help the mother get a settlement visa. It is possible to apply for a settlement visa without a job already waiting in the UK so long as you have some savings. But is is more likely to be approved if you are already have a job offer in the UK or having even ...

I doubt there is a actual figure stated, but the amount the ECO is looking for will vary. Eg Is there free accommodation in a house (relative/friend), or are you paying for hotels?

She will not be able to re-enter the UK on her existing visa as it would have expired. They may let her re-enter as a visitor with a new 'stamp'. Does anybody have any experience with this? Try reading vinny's links. It's not just having a two year relationship, it's about living together and having a relationship akin to marriage/civil partnership for at least two years. What evidence have you got to show this? Really not a good idea to overstay and that is likely to make things diffi...
