you need 100 points total
80 points without the english language and maintenance points

so you need to earn 40 points for salary, which is £65,000-£74,999

As you can see, earning requirements can be very hard to meet for Tier 1's granted after 6 April 2010.

Which specific visa are you referring to here?

If a marriage visit visa, she will have to go home afterwards and reapply. If a fiancee visa she can switch into spouse visa.

1) Time spent living together in any country counts, as long as you have sufficient proof.
2) Tier 5 YMS can only switch into unmarried partner and spouse visas, so you are OK provided you meet all other requirements

Previous Earnings - possible to claim 13 months earnings?

Is this possible? Here is a simplified example: Claiming for period 8 Jan 2010 - 7 Jan 2011 1) Say I am usually paid on the 10th of the month, for work done the previous month, so I would have payments: 10th Jan 2010 10th Feb 2010 ... 10th Nov 2010 10th Dec 2010 (12 payments in total) 2) Now what if...

You need to be physically present in the country where earnings were made in order to apply any uplift ratio.

The funds being deposited in another country/currency does not make any difference.

Page 12 of the document. There's no mention at all on the 10/14 year settlement routes? The document is titled 'EMPLOYMENT-RELATED SETTLEMENT, TIER 5 AND OVERSEAS DOMESTIC WORKERS' I do not see that the 10/14 yr categories fall under this description, hence they are not in the scope of the document...

The proposals for Tier 2 seem quite radical.

Existing Tier 1 holders look to be OK, there is some suggestion of removing the ability to extend for a 2nd time (while preserving the right to settlement), however even this option is downplayed in the document.

mulderpf has given the correct answer, if you're not convinced read the policy guidance.

There's already a 2 page thread on this simple concept, let's hope this doesn't turn into another one.

They have been doing them intermittently at Heathrow (in particular T2 IIRC) for years.

They are UKBA personnel and they check that you have valid leave.

But as an Australian he can leave and reenter, and try his luck in being granted a tourist visa.

Generally if you have enough evidence to prove your intentions you will be OK, however I personally know of at least one occurrence where entry has been denied.
