Being born in HK is of no benefit to you in this situation.

You can apply for any of the normal routes you are eligible for, ie: Tier 2.

Interesting to know, that is similar to the exit checks I have experienced at Heathrow ie: visual inspection of passport, however in my case it appeared they were checking for valid current leave.

There is every chance such (exit)checks will become more commonplace.

FWIW, I was checked both ways when I took the train a few weeks ago. Yes, on your way to France by Fench immigration at Kings Cross, and on your way back by UK immigration at Garu De Nord. ie: you were not checked on exit by UK immigration. You can only hold one visa at a time - your Tier 1 is cancelled if you are granted a Tier 2 visa.

He is not a new applicant though - IIRC it was previously possible to apply for an extension from outside of the UK as long as salary requirements are met without applying any uplift factor. Vinny, are you saying this is now not possible with the new rules? The link you gave refers to new applicants...

From what I recall you can get an extension without showing any UK income at all, provided your overseas earnings meet the required points wihtout applying any uplift factor.

The convictions are likely considered as spent and in any case are not taken into consideration when applying for Right of Abode.

Checking the application will probably confirm this ie: do they ask for criminal convictions?
