There is no such rule which states that company should be opened 3 months before application is made. You misinterpreted this rule.

Go for the appeal (if given right) with the same argument which you are giving above and hope for the best.

Then I think your reply was OK for not transferring money to the UK coz you can not start a business until you get the visa. So why transfer money in advance when visa application is already jeopardize and in appeal.

I think, You should be worried bcoz

I think, If upper tribunal accepts Home office appeal then your earlier victory in FTT is meaningless as case will be heard kind of from the scratch.

If you are under 200k cateogry, then may be you can. But if you are under 50k psw category then the answer is no. If you have got the right of appeal in this application then go for Appeal. This whole appeal will be based on the refusal/deception you received 2-3 years back. Correct me if I am wrong, there is no expedite route to nationality.. Everybody needs to pass 5 years in UK to apply for Nationality. I think you can qualify for ILR and extension by staying no more than 6 six months outside each year. However

I think you need to be director of the company you are investing in. And your job title should be NVQ level 4 or above. Just my opinion..
