Hi Vickivickii,
Appeal went well,was only asked a few questions about refusal and then the judge said based on the evidence he has heard the visa will be granted (hooray!!!!!) just needed it in writing,so back to waiting again.

From the refusal date to the appeal hearing it was 6 months for us but it varies from which country you are from.

Yes just claim JSA in your name.The only thing you can have in joint name is tax credits all other benefits in your name only.It will not effect her status.

You should try phoning them,they are always helpful.They also back date payments up to three months.

So long as you claim the Housing Benefit and Job Seekers in ONLY your name that is no problem.
You are also entitled to the tax credits but that has to be done in BOTH names and is actually not classed as "public funds".

Sorry just noticed you are applying for fiance visa,obviously he won't be allowed to work till you are married and changed to a spouse visa so job offer will not be necessary.

Yes it probably will go down because your working tax credit will be based on both your incomes .
I am in simular situation that i have the tax credits but to strengthen the case i have provided evidence of a job offer for when my hubby returns,this can only make your case stronger. Good luck.

Hi, as far as i understand it you are allowed to claim housing benefit for yourself but not your hubby.
The main question is will your have to resort to additional public funds? this is what they are looking at.

Hi, i had to do this and it was very simple,call the council for private housing,organise a date ,they come to your home,check the size then go and few days later got my report saying the house will not be over crowded.It is also free!!

Great news Broomie i can imagine the relief you have.I am just waiting for my hearing date and am preparing further evidence to send to the AIT. My question is at the hearing did the judge just discuss the refusal questions or go through the whole case again.. thanks and congratulations again,
