Re: EUSS settled status, loss of EU citizenship

It does not matter whether the caseworker checks or not. It is your responsibility to declare that you no longer hold German citizenship and should have done so at the time you lost your citizenship. It would appear that you no longer have the right to remain in the U.K. and should have left at the ...

Re: Can I apply for PSW while on police bail?

You must declare the arrest and your current status under police bail if you intend to apply now. Note that police bail can go on well beyond the date given initially. Your application will ask At any time have you ever had any of the following, in the UK or in another country? A criminal conviction...

Re: DCOS assign to brother

What exact wording did you put on the sponsor note - that could be crucial in deciding whether the caseworker considers if it was you by default that issued the COS as opposed to the level 1. If you instructed the level 1 to issue the COS as you are their employer, that places a number of questions ...

Visa rejection is not a refusal. So there is no reason to declare rejections.

Re: Visitor visa for my mother (2)

If you are supporting your mother on a monthly basis and she herself has minimal funds then you might find that is a major barrier. The Home Office is not kind when it considers payments received from sponsors, they treat it as a negative along the lines of the overseas individual is not able to sup...

Under category B 12 months of payslips and the matching payments to the bank account would be required.
If she did not deposit the full amount of cash she received into the bank then the payslips/income is disregarded.

Re: Apply for mother while i am in PIP

If your mother can afford to get herself here and have some funds to spend that are reasonable for the duration then it will not matter that you are on benefits or PIP. If you are able to provide accommodation then that should be stated. The main points thereafter are the ties your mother has with h...

Re: ILR & eGates - can they change visa status? And how to check?

As a side point - once the e-visa system comes into use then there will be a viewable audit trail of entry available across the different parts of the Home Office. While people imagine this is available now, that is not the case. This will make the e-gates earn their keep properly as it should confe...

Re: Received top up slip for ISC payment - what do I need to do?

It is not the correct procedure to send the ISC payment request to the prospective employee, I think that was sent in error or as suggested as a warning to get the payment made by the employer. Have you checked with your employer that they have received the request for payment and if not the best yo...

Re: Skilled worker visa after 4th April | Help needed

Once a COS is withdrawn by the Sponsor then it is out of the system. You cannot go back and revise or revisit or try to claim the date of prior submission. If the COS you have was assigned before 7pm on 4th April the old rules apply. If it was assigned after that time then the new rules apply. There...

Re: ILR absence and citizenship

The Citizenship absence period is very strictly enforced. If you are out of the country for elective reasons, such as seeking medical treatment then it is highly unlikely that would be a considered compelling and exceptional reason to wave the absence period. If for example you were involved in an a...

It is the date of initial claim - so the date they contacted the Home Office.

As for a switch to skilled worker visa, likely to be refused due to the period of overstay prior to asylum claim.

What visa are you currently on? That will help determine the rate you could qualify for. If you are on a graduate visa you may qualify for the new entrant rate so that changes things.

Re: Reported breakdown of marriage not heard anything

I believe the spouse has not yet traveled so is not in possession of a BRP? I would suggest the visa validity is 100% confirmed before any travel is undertaken. You will not readily be able to explain the situation at the point of entry. If the visa has been cancelled then that will end in a world o...

You may have a technical problem regarding your ILR by the very nature of your employment -
You must not travel outside the UK, Ireland, the Channel Islands or the Isle of Man until you get a decision. Your application will be withdrawn if you do.

I am afraid the SAR is very likely to take longer than 28 days. There is a distinct lack of resources in the police services and SAR’s routinely & unfortunately are rarely delivered early. There is not a route to speed the process and most people are grateful just to receive it close to 28 days. You...

Until a change is announced or proposed no one can answer that question. IF and that is a massive guess type IF there is a change it is likely to be that ILR will not be considered until a period of 5 years actual residency is achieved. So periods outside the UK could be discounted - therefore you h...
