Re: Question about Assylum seeker work permission!

It is the date of initial claim - so the date they contacted the Home Office.

As for a switch to skilled worker visa, likely to be refused due to the period of overstay prior to asylum claim.

Re: Salary on defined COS if decision is made after 4th April

What visa are you currently on? That will help determine the rate you could qualify for. If you are on a graduate visa you may qualify for the new entrant rate so that changes things.

Re: Reported breakdown of marriage not heard anything

I believe the spouse has not yet traveled so is not in possession of a BRP? I would suggest the visa validity is 100% confirmed before any travel is undertaken. You will not readily be able to explain the situation at the point of entry. If the visa has been cancelled then that will end in a world o...

Re: Early ILR Application Refugee Flight Crew

There are exceptional circumstances that can be considered but you would have to contact UKVI and have that discussion. Given your job role I would be hopeful that some consideration would be given, however there is no guarantee. The single biggest issue would be getting hold of the right people / t...

Re: New entrant criteria - SQE

Paralegal role is not considered as a training role. It is a defined role within the legal profession in its own right. Therefore the use of the role to work towards full qualification is useful but it is not a training contract. Therefore the full rate for the role will have to be met. If your pros...

The more evidence you supply the better. If you apply without the police evidence then that will diminish your claim.
Of course you can apply with what you have, that is your choice.

Re: Early ILR Application Refugee Flight Crew

You may have a technical problem regarding your ILR by the very nature of your employment -
You must not travel outside the UK, Ireland, the Channel Islands or the Isle of Man until you get a decision. Your application will be withdrawn if you do.

Re: Indefinite Leave to Remain via the Domestic Violence Route

I am afraid the SAR is very likely to take longer than 28 days. There is a distinct lack of resources in the police services and SAR’s routinely & unfortunately are rarely delivered early. There is not a route to speed the process and most people are grateful just to receive it close to 28 days. You...

Re: Absence in spouse visa

Until a change is announced or proposed no one can answer that question. IF and that is a massive guess type IF there is a change it is likely to be that ILR will not be considered until a period of 5 years actual residency is achieved. So periods outside the UK could be discounted - therefore you h...

Re: Skilled worker dependent visa - Vignette Transfer

The basic rules for transfer are - you have not traveled - obviously. The intended travel is after the expiry of the vignette and within the date of the expiry of the visa granted. For dependents there is not a window / timeframe that you have to meet for the vignette transfer as long as it is befor...

Taken from an immigration site Here is everything you need to know about a Vignette Transfer! So, you couldn't arrive into the UK during your 30 day clearance due to unforeseen circumstances and now you are not sure what to do? What will happen with the entry vignette (30-day entry clearance) and yo...

Re: Help needed for visa application SOC

The date of assignment of the COS sets the guidance in place. Choose the updated SOC code and it should let you proceed. The caseworker will examine the two different SOC's to ensure they match from the old to the new SOC list. As a double back up your sponsor can add a note to SMS saying the SOC is...

Re: 7 year route on basis of private life

Once your dependents have been in the U.K. for 5 years then they will be able to apply for ILR. This is based on your continuing stay under your current or future qualifying visa. The seven year rule relates to children of parents with no leave under mostly failed asylum claims. It is not going to a...

Re: ILR application withdrawn- urgent advice needed please

There is no appeal process for withdrawn applications as it is not an immigration decision. The application was abandoned by the exit of the applicant and therefore the applicant is unable to meet the requirements as they were no longer present in the UK. The issue is that the main applicant is outs...

That is a self serving declaration in effect, so not likely to be treated as anything other than that. You have to have other documents surely? School reports, doctors records, church records, there has to be historic documents that link you on the balance of probability to the fact that the childre...

Re: Skilled Worker Child dependant visa - refusal

The other barrier to any documents submitted from Nigerian sources is the general view that there is a high possibility that they are forged or constructed for the purpose of immigration purposes. Hence letters from a hospital that pertains to four separate children over a spread of years is not rea...

Given the refusal and the obvious issue that there is a belief the children are not the OP’s then the suggestion that a hospital and school letter will overcome the issue is rather optimistic.

General statements from gov.uk are not a great place to gather the detail. You need to look at the law or the caseworker guidance for the detail.

As long as the COS was assigned before the cut off point the previous rules apply. If the rules in play for the job role meet the higher of the thresholds be it rate for the job, national living wage or £26,200 then it will be fine. There are lower rates of pay for shortage occupations and new entra...
