Re: Salary requirements-Spouse works for me

If your wife is working for the company you own there are other considerations. You will need full accounts showing and the payslips and bank statements that you are formally paying salary to your spouse on a monthly basis. Your income will only be from the annual accounts so either dividends or for...

Re: ILR & eGates - can they change visa status? And how to check?

As a side point - once the e-visa system comes into use then there will be a viewable audit trail of entry available across the different parts of the Home Office. While people imagine this is available now, that is not the case. This will make the e-gates earn their keep properly as it should confe...

Re: Received top up slip for ISC payment - what do I need to do?

It is not the correct procedure to send the ISC payment request to the prospective employee, I think that was sent in error or as suggested as a warning to get the payment made by the employer. Have you checked with your employer that they have received the request for payment and if not the best yo...

Re: Skilled worker visa after 4th April | Help needed

Once a COS is withdrawn by the Sponsor then it is out of the system. You cannot go back and revise or revisit or try to claim the date of prior submission. If the COS you have was assigned before 7pm on 4th April the old rules apply. If it was assigned after that time then the new rules apply. There...

It should not be an issue as long as the SOC and salary meets the education sector standards- see below

Re: ILR absence and citizenship

The Citizenship absence period is very strictly enforced. If you are out of the country for elective reasons, such as seeking medical treatment then it is highly unlikely that would be a considered compelling and exceptional reason to wave the absence period. If for example you were involved in an a...

It is the date of initial claim - so the date they contacted the Home Office.

As for a switch to skilled worker visa, likely to be refused due to the period of overstay prior to asylum claim.

What visa are you currently on? That will help determine the rate you could qualify for. If you are on a graduate visa you may qualify for the new entrant rate so that changes things.

Re: Reported breakdown of marriage not heard anything

I believe the spouse has not yet traveled so is not in possession of a BRP? I would suggest the visa validity is 100% confirmed before any travel is undertaken. You will not readily be able to explain the situation at the point of entry. If the visa has been cancelled then that will end in a world o...

Re: Early ILR Application Refugee Flight Crew

There are exceptional circumstances that can be considered but you would have to contact UKVI and have that discussion. Given your job role I would be hopeful that some consideration would be given, however there is no guarantee. The single biggest issue would be getting hold of the right people / t...

Re: New entrant criteria - SQE

Paralegal role is not considered as a training role. It is a defined role within the legal profession in its own right. Therefore the use of the role to work towards full qualification is useful but it is not a training contract. Therefore the full rate for the role will have to be met. If your pros...

The more evidence you supply the better. If you apply without the police evidence then that will diminish your claim.
Of course you can apply with what you have, that is your choice.

Re: Early ILR Application Refugee Flight Crew

You may have a technical problem regarding your ILR by the very nature of your employment -
You must not travel outside the UK, Ireland, the Channel Islands or the Isle of Man until you get a decision. Your application will be withdrawn if you do.

Re: Indefinite Leave to Remain via the Domestic Violence Route

I am afraid the SAR is very likely to take longer than 28 days. There is a distinct lack of resources in the police services and SAR’s routinely & unfortunately are rarely delivered early. There is not a route to speed the process and most people are grateful just to receive it close to 28 days. You...

Re: Absence in spouse visa

Until a change is announced or proposed no one can answer that question. IF and that is a massive guess type IF there is a change it is likely to be that ILR will not be considered until a period of 5 years actual residency is achieved. So periods outside the UK could be discounted - therefore you h...

For dependents there is not a window / timeframe that you have to meet for the vignette transfer as long as it is befor...

The date of assignment of the COS sets the guidance in place. Choose the updated SOC code and it should let you proceed. The caseworker will examine the two different SOC's to ensure they match from the old to the new SOC list. As a double back up your sponsor can add a note to SMS saying the SOC is...

Once your dependents have been in the U.K. for 5 years then they will be able to apply for ILR. This is based on your continuing stay under your current or future qualifying visa. The seven year rule relates to children of parents with no leave under mostly failed asylum claims. It is not going to a...

There is no appeal process for withdrawn applications as it is not an immigration decision. The issue is that the main applicant is outs...
