Re: urgent ...overstay

@ Kaji, if you submitted your fresh application about 10days after appeal was dismissed, then your application should have been valid as you have 28days after appeal is dismissed to submit a fresh application. Can you state the date when appeal was dismissed and the date you submitted your fresh ap...

Re: Spouse Visa after Deception

It is very difficult to advise someone who gives such inconsistent information. In your first post you say your tier 1 extension application was refused and quoted the refusal letter, in the second post you said that your application was withdrawn before a decision was made. If they can they will re...

Re: Spouse Visa after Deception

Your application has been delayed because of your previous use of deception to obtain leave.

Did you declare your deception in your tier 2 dependant visa application?

When did you leave the UK? Was this voluntarily and at your own expense? When did you marry your wife? Do you have children?

Re: Tier 4 after Doctorate Extension Scheme

You won't have established presence as you haven't completed a course of at least 6 months' duration in your most recent period of leave. Do you have a specific course in mind at a specific institution? Have they made you an offer yet and do they know your immigration/academic history. It would be u...

You don't have tier 1 psw leave so your wife can't apply as a tier 1 dependent.

Re: partner/family visa help

If you are applying from outside of the uk then it's only your partner's income that will count not yours. She will need to she has been earning the required amount over the last 6/12 months and that she has a job offer starting within 3 months of returning to the uk earning the required amount.

Re: which visa category???

Whether or not you have discretionary leave or leave on long residence grounds (which is what 276A covers) your wife won't qualify for a visa as your spouse until you have ilr.

Re: Overstay

If you submit an application as an overstayer then you continue to overstay while the application is outstanding. Making an out of time application does not stop the clock on the overstay.

Re: Marriage breakdown/Seperated

I also need someone to advise me if the address above on my first post is correct to where I sent my letter to home office explaining my situation. Someone told me to write to home office so that they do not issue her an indefinite stay as she may try to report that our marriage was a domestic and ...

Re: Established presence

A person qualifies for established presence if they are continuing on the same course for which they have ready completed 6 months. I would say that would be very risky to rely on the established presence rule where they are transferring to another institution, as the home office are likely to say t...

If your appeal was granted on article 8 grounds then you would've been granted discretionary leave outside the rules. You can't bring your wife until you have ilr.

It is not advisable to refuse all contact in this situation. They are already going through mediation and it seems as if limited contact has been agreed. If she refuses all contact then he can take her to court and the court is likely to order contact. She will find it difficult to prove that he onl...

Thankyou for your reply. I can't have him take my child as he isn't responisble enough. There have been many cases where he has been present and the little one has injured himself because his father was too busy chatting to his 'female friends'. Careless. Also if he'd get custody he'd probably run ...

Re: Urgent Query Appeal FLR FP Ipswich address

No they will list it based on your address not your solicitors. They will not move the hearing to London because your solicitor is based there. It is your choice to instruct solicitors in London and your solicitor could equally instruct a barrister in the north to attend the hearing.
