No, she was Tier 1 dependant since 2009 and before that student visa not my dependant So 319E(d)(ii)(c) does not apply anyway - she has never had leave as dependant in any other (non-PBS) immigration category. The term "dependant" is generally used to refer to spouse or civil partner, unmarried or ...

Has your wife ever applied for leave as a dependant in any immigration category other than as a "PBS dependant"? Do note that HSMP between Nov-2006 and 2008 is considered "PBS category". Thanks very much, I really appreciate your time and responses. No, she was Tier 1 dependant since 2009 and befor...

I have read it through and responded only after that. 319E(d)(i)(b) states under the Rules in place before 9 July 2012, and since then has had continuous leave as the Partner of that Relevant Points based System Migrant, the specified period is 2 years AIUI, continuous leave = continuous immigratio...

Just something to add here from " Family members of points-based system migrants -This guidance is based on the Immigration Rules Combining Leave For ILR (Page 33) Can you shed some light on this? Pretty clear that the dependant must have had immigration status of spouse, civil partner, unmarried o...

As Vinny has already stated, the reference to "spouse or civil partner, unmarried or same-gender partner" in 319E(d)(ii)(c) refers to the "immigration status" of the person as "spouse or civil partner, unmarried or same-gender partner" rather than just their "relationship" as "spouse or civil partn...

Questions: - Can he apply Tier1 dependent in the UK? (i.e. switch from PSW to Tier1 dependent) I think No, unfortunately needs to seek EC from India - Can he apply ILR along with her in Feb2014? (as 5 year rule started in July2012, but 2 year still applies for people already in the UK?) That is als...

However, E-ILRP isn't applicable here because E-ILRP.1.3 isn't applicable for applications under 319E . Ok, thanks for the information, I can understand this is relevant to settled/British/in the UK with refugee leave or as a person with humanitarian protection whereas 319 E is relevant to PBS depe...

E-ILRP.1.4 is probably significant if your partner runs off with someone else? Then the previous periods with you cannot be included for your ex-partner's ILR. My wife is with me since we got married in 2006, so that means E-ILRP.1.4 is relevant and case worker should calculate based on previous le...

Thanks Vinny, this is what more concerns me, I am really worried, I was thinking my wife student visa (when she was not my dependant) will not count towards the probabtionary period for 5 years but I was quite hopeful her first entry clearance as my dependant in January 2009 will be ok to count towa...
