Re: DO I NEED VISA AFTER CURTAILMENT?

If you're a non-visa national, and you didn't overstay the Tier 5 visa or get into a deportation situation, then you should be able to come in for business or holiday without a visa. You will, however, have to satisfy the border officer about your intentions and that you won't work etc.

Re: Tier 5 visa expiry

You can be paid after your visa expires for work you did before it expired. No problem there. Bank - don't know. Coming back - it's going to look suspicious. The border officer may take some convincing that you're going to leave. Bring proof. They'll ideally want you to wait for the outcome of the e...

Re: Youth Mobility Scheme Application UK

The fact you've been on a Tier 5 (creative and sporting) CoS in the past should have zero bearing on your new application. You did nothing wrong and had permission for the tour (or whatever it was).

Re: Tier 5 Creative - Resident Labour test

Sometimes an RLMT is provably irrelevant. But, even where advertising etc. would be daft, the sponsor must always be able to prove that no settled workers are being displaced or denied job opportunities. If you work in the fields of theatre, dance, or film & TV, your sponsor must show you meet the r...

Re: Tier 5 Creative - Resident Labour test

It's not always mandatory to meet the RLMT. For instance senior creative grades (director, producer, editor etc.) working on a film temporarily in the UK are deemed to meet the RLMT without advertising, as per the code of practice for film workers. Also, for entertainers, if they're very famous then...

Re: Tier 5 (temporary work) creative worker

Yes, it's fine to issue a tier 5 CoS to a sound engineer on tour with a band, if he's their regular sound man. But when it comes to a teaching company employees how to use a piece of software, I'm not so sure.

Re: Tier 5 (temporary work) creative worker

This might not be classed as "creative and sporting". This category is for entertainers. For instance bands on tour, or footballers coming to play for a UK club. I think a broadcast technician might not fall into this category. It sounds more tier 2 to me.

Re: DUI Conviction from about 3 Years Ago, Problem?

It's not a mandatory refusal; that's all I can say. They have the right to refuse on a discretionary basis, but in my opinion they're unlikely to do so in this case. Usually a discretionary refusal would be on the basis of repeated offences or criminal associations. You don't fall into a mandatory r...

Max 24 months on same stay. But you could then leave and get a new visa and start all over again.

Re: Tier 1 Exceptional Talent application (non tech)

If you're wondering about qualifying for Exceptional Talent then apply for Exceptional Promise instead. The ET one is for people who are already at the top of their industry. Award winners and those who are already successful. Exceptional Promise is for people who might soon be very successful.

Re: Exceptional Talent visas open to non-performers?

It's open to poets (one of the first videos on the subject posted on the Arts Council website was an African poet who'd got the visa) so should be open to composers and producers too. Especially if you compose/create music, rather than simply doing what others ask or tell you to do. They're big on c...

Re: Entering the UK through Republic of Ireland

There's no simple solution to this passport stamp issue because they may refuse to stamp you even if you go to Belfast airport. It's also impacting bands on tour; their UK work permits can't be validated at the border between Ireland and the UK, so they're technically working without the correct sta...

Re: Tier 5 Creative Sponsorship curtailments

Call the Helpline back, telling them your man is moving sponsor within Tier 5 (creative) and you want to know what to do. There must be something you have to do, so ask what it is. If they sound unsure allow them to look into it; but don't allow them to guess. If it sounds like they're guessing ask ...

Re: Entering the UK through Republic of Ireland

If you enter first via Ireland then you get an Irish entry stamp. Further travel (by road or air) to Belfast or London is counted as internal, hence not subject to a check or stamp.

Re: Tier 5 Creative Sponsorship curtailments

I've never done this as I don't ever do in-country applications but it stands to reason that someone would be able to switch sponsor in the UK without having to go to their home country and apply for a new visa. Surely this happens in tier 2 all the time. (Tier 2 is mainstream jobs like banking, doc...

Re: Tier 5 Creative Sponsorship curtailments

He can apply to extend/vary his current status. He would need the new CoS, as he has to quote the 11-digit CoS number on the application. He does not have to go back to Zimbabwe.

His sponsor should know all this and should be more forthcoming with information.

I would advise against leaving and trying to come back in as a visitor; there is a risk you would be denied entry because you'd be here to work in Ireland without the right visa for that.

Re: Permitted Paid Engagement Clarification

No, I don't think so. You'd have to be an entertainer or high-profile public speaker to qualify for that. It's meant for artistes doing performances or "an evening with (insert actor's name here)"; that type of thing. You may be able to come and give a seminar as a visitor if it's unpaid. Only if it...

Entertainers beware coming to the UK via Ireland

The UK Home Office has recently decided to 'clarify' the position on entertainers who come to the UK via Dublin. They're now saying any entertainer or sportsperson coming via the Republic of Ireland, who does not hold a UK visa before they travel, is unable to work legally in the UK. If they hold a ...

Well, don't lie (obviously). You can say you have a home you use occasionally but don't use it as your main residence.
