As they have both just graduated and every penny counts, i'm positive that it wont be in person, they ll apply by post. Finan...

Re: Retention of Rights - Quick Question

Everyth. you stated fits in perfectly. You just need to keep working yourself until the 5 years from your "marriage" are up (not until the expiry of your RC). I think if you submit all the docs you listed and then even a copy of EEA's ID(not really required), this should suffice for your application...

hmm... this is a problem, the fact that you will obtain EEA1 doesn't mean that you will then obtain a Document Certifying Permanent Residence by applying in 2010 on EEA3. They will ask you on that EEA3 form how you exercised you rights in the past 5 years! In each category they will need to see proo...

Well done, that shows how people should use their entitlement. Ok, if u have been looking for work since Sep'09 u DO NOT need insurance as u will be classified as a worker and exercising ur treaty rights under that 6 Regulation i quoted above. U fulfil its requirement, so, what proof can u show for ...

http://www.immigrationboards.com/viewtopic.php?t=46826&start=20 Hi, I finished working in the middle of November. I have been self-sufficient since then and didn't know that the comprehensive medical insurance was required. I just bought it now and it is valid since yesterday. However, could you sha...

Sufficient Funds and Accommodation Query- ILR

1) the requirement of having 105 disposable pounds per week? Is it the same requirement for those applying for ILR? When my sister applied for her FLR(M), she didn't really work per se, only part-time. And her husband also part-time. They had some savings though, I presume that was what they took in...

Hey Obie, why don't you at least qualify your advice and say that it's only your opinion and weird interpretation! Sub-paragraph (2)(a) of the section 5 you referred to, which you omitted for some reason, states that she has to have reached the Retirement age for this particular provision to apply. ...

This is a very good point, well spotted! 5 yrs for your wife will start to tick from the time you can prove exercising your treaty rights and not when she was issued with the residence card. one final bit, if you are worried about her EEA card expiring in October 2010, there is a simpler way... if she can get a duplicate passport, like yourself, from the Thai embassy, without annulling her older one, simply apply for another EEA2 card, which is valid for 5 yrs. Then, in October, with th...

I don't know if you thought of Plan B from reading my topic on not getting caught out or it's obvious to everyone :))) Both Plan B and C are kind of illegal, as for a divorce you MUST have a valid and genuine reason. We are civil, it's just everyone must remember that when giving advice, it's not what is legal that counts, but what is PRACTICAL! In another post, with Megie83 you suggested that it doesn't matter what type of insurance, if any, she should obtain, whereas I suggested that, as she has a choice and a...

Re: Retained Rights

I think you should state that you are writing to inform them of the divorce, and that you retain the right of residence in the first letter with the copies, which you intend to send on 4 Jan 2010. There, you will also explain to them that the originals are not attached as you require them for the PR...

Ivan, there r conflicting views because this scenario has NOT gone to court on this issue! Contrary to what Obie has written about Baumbast! That case refers to those applying for a residence card and u can only cite it if u go to court to draw paralels. The fact that it says Guru under Obie's nick ...
