You need to declare it because it will come up anyway when background checks are run. Your application may be put on hold until police/CPS decide what to do. If you are charged delay would prob then continue until the prosecution is over. Don't even think of not declaring it. That would be deception...

Does the US court permission allow you to remove the children to UK/Ireland permanently or only for visits? If the latter you could find yourself caught up in Hague Convention proceedings with your ex for child abduction.

Para 9.7 - you were not compliant during part of 2010. I suspect you will need to wait until 12 October 2020 to be clear of the 10 years since breach rule, but you are free to take a chance and risk losing the fee. Agree that a flight back to the UK is a non starter. The airline will not even let your new wife onto a UK bound plane. She is a visa national and the airline will want to see a valid visa. Talk of EEA family member will cut no ice with them.

Declare eveything rather than trying to play the stystem. They are unlikely to be a problem and you really don't have a choice. UKVI will know about them, so if you don't declare them you may be refused, not forthe penalty but for lying on your application. That gets you into a whole different world...

Brexit hasn't happened yet, only the referendum to start the process.

Timelines are meaningless. The service standard is still six months, so those receiving cards now applied for them months before the referendum.

Just tell her to expect routine questions and to answer honestly.

As to why travelling alone "my husband only gets five weeks vacation a year and does want to spend three of those weeks with my mother" would probably convince most IOs.

The correspondence between your employer and UKVI is about an application for an allocation of CoS, not about a named migrant. Your employer may have done a good job justifying the need for migrant labour but UKVI didn't accept the need existed, or your employer did a bad job setting out their case ...
