About proving your residence....Since one is granted PR, like myself, I assume that there won't be a need to prove those 5 years again. Will I only need to prove the last year? (say Sept 12-Sept 13)

Your friend needs to hire a solicitor to represent him. The case is complicated. Without being able to prove that his wife exercised Treaty Rights for 5 years, and common residence it will be extremely hard, expensive and lengthy.

Hi all, I got a ¨something for you¨ card from Royal Mail this morning. I missed their delivery. I tried to pick it up today, but was told that it is still with the driver. I will try again later today, otherwise I will have to wait until Monday. I think it might be something from UKBA. The code AU X...

Without doubt everyone has distinctive case implications based on their past immigration records and other relevant factors. And yes for members past stories does not mean to track back the decades but few months. And again this forum advises should be used as a secondary source. In last this forum...

You don't need to leave, no. It might complicate the situation when you will be entering the UK, and when an immigration officer asks for her whereabouts. When she is not using her Treaty Rights neither can you, especially when she is not in the country, but again no one has to know. You are not doi...

Totally agree. It's a stupid formality. Anyone could provide those whether or not one lived at the suggested address.

Do you know any case that was refused based on lack of proof of residency? Also, do you need to prove the whole 5 years or only 3?

Securitas. If the UKBA came to your home to verify whether or not it's a marriage of convenience it is because someone or something has alerted them of that. Have your wife politely contact UKBA with a reasonable explanation.

securitas. You need to be a bit clearer. 1) When did you your wife move out? 2) Where is she now? 3) Was she working / studying the whole time you were together? 4) Has any of you applied for separation / divorce? As I said before, special circumstances are sometimes considered when an EEA and non-E...

Your interview is on Thursday, and they will be able to make a decision about your application then and there, I imagine they will hand everything back to you on Thursday, regardless of the decision. Call them, until you find out for sure.

When were you issued the RC? How long have you lived together? Where is your wife? What application are they going to review if you already have the RC? It would be a good idea if you get your wife to write a letter to the UKBA explaining why you are not currently living together and that this is no...

Excatly. That's why an application is required. You are right in priniciple but your suggestion is obsolete, having in mind the current variance in necessity and the regularity of the specific cases on what interests the UK. Implementaion then becomes of a periphral nature.

smuru, It is practically impossible for your suggestion to be applied hence it´s silly that you are so convinced that it can work. UK has adopted Directive/2004/38/EC and thousands of people like us have benefited from it and I am very thankful for it. Perhaps, you should too. Member states are requ...

Marriage certificate etc. It doesn't matter if its difficult for them or that the UKBA have put the burden on them. That is what Article 25(1) demands. It is up to the government to set the system up in compliance with the directive. For example, documents could be checked at a police station on be...

Yes, with a passport and marriage certificate. It may cause uncertainty for employers but it is what Article 25 specifically allows. Practically, it is impossible. You can't possibly expect ALL UK employers to be able to recognize hundreds of marriage certificates from around the world. You would t...
