Re: COA with work - Definitive proof of application success?

Documents issued under the EEA route are not granting but confirming rights the applicant already has (except in the cases of extended family members, who usually receive a short CoA without confirmation of the right to work). In that sense, the caseworker does not have to approve anything. That's ...

Re: Recent EEA(EFM) to convert to EU settlement scheme

I think it will be unfair to asume it will a presettled status, before knowing for how long he has been in a durable relationship with his partner. The requirements for settled status are generously, if he can prove five years residence with his partner. I stand to be corrected.

Re: My experience: Traveling while waiting for PR

I believe there has been some kind of caution towards the so called HOSTILE ENVIRONMENT towards immigrants as a result of the public outcry since the windrush Scandal.

Re: BREXIT WITHDRAWAL AGREEMENT.

Extended Family Members (other than durable partners) are excluded from the scope of the Withdrawal agreement and explicitly put under national jurisdiction(Paragraph 14). Wasn't this always the case? for extended family members, it was the member state exercising 'discretion' under its national la...

Re: Do dual EU-UK citizens have rights under EU law?

Looks like the judgement does cover just one section of family members, not Other family members. And in light of the on going Brexit negotiations on citizen's rights, it's obvious the ECJ could not contradict with what the EU negotiators are pushing for after Brexit, that current EU citizens exerci...

Re: non EEA (PR) EFM appeal SALA problem - what to do

Thank you for your replies about 'Sala' not applying in my case. Until I receive the Judge's decision I am still concerned because the Home Office tried at the hearing to get the Judge to rule 'no jurisdiction due to Sala'. He refused saying that it didn't apply as this was under 'Regulation 7' now...

Re: EEA PR REFUSAL AND BREXIT

Our EEA PR application has been refused in 2016 and we have appealed. The last line of the decision states that "As a EU national you are not required to leave the United Kingdom as a result of this decision". Hence my questions are. 1.If in case our appeal is also refused, will it effect our resid...

Re: EEA application status - online

Thanks for the info! It did not work with Case ID found on my COA but it worked with Royal Mail Tracking. Anyone else with this status: 'Awaiting a decision. Application status updated on 21 April 2017' ? Many thanks! When did you submit your application? Can you try with the case ID, but omit the ...

Re: EEA application status - online

ID CASE number or reference will as well work, just omit the 1st letter and only enter the figures. the only difference is that when using the royal mail tracking reference, the dates that your application status was last updated defers from the one you get when you use your CASE ID. However the sta...

Re: NEW EEA Regulation that violates EU law coming into eff

The Home Office has decided to bring new laws from 25-11-2016. Some of this laws like the Surinder Singh changes are designed to deliberately breach EU law. It appears that the Court will be very busy. The most immediate of the changes, is making it clear that Extended Family members have no appeal...

Re: Rise in Xenophobia and hate since Brexit

Fear and intimidation has always been the culture of British politics! Aren't all governments like that? At least western governments aren't as bad as some of the third world governmernts. What do you mean when you say third world governments? Is the UK on a different plannet? How much of British h...

Re: Latest on EU citizens

"Reciprocal" can mean different things to different people. Indeed. And there's a fine line between a numerator and a denominator. Only a fraction of people appreciate that. I think we have to understand the nature of the community on this discussion board. We are discussing immigration, which is a...

Re: Latest on EU citizens

The PR is a right under EU laws while ILR is under UK law. When the UK officially exit the EU. The PR probably will be invalid after a certain time or cut off date, similar to any immigration visa.. This is why I think that, apart from for the purpose of naturalization, there's little point in appl...

Fact is you are all viewed in the same way as a refugee in the eyes of the true British ...

Re: Is your evidence credible?

Sorry if this sounds very negative, but if you have lots of evidence and it keeps being rejected then, Looking at it from the HO's point of view, they must be thinking: If you were genuinely a dependant why didn't you apply for an EEA Family Permit as a dependant with your brother sponsoring you?
