Obie to be honest, in the OP's post i wasn't interested in the marriage coir's part of it,i might have skipped it. Sure it might raise suspicions as to why the applicants are not revealing the actual category under which they are exercising their treaty Rights. About UKBA scrutinizing everything, i ...

Treaty right has to be genuine. The UKBA knows her treaty right's position , if she is working or self-employed. They will not help by telling you not to provide this. They will say the onus is on you to provide this information. Simply providing a Sickness insurance for someone who is not aware of...

Ain't intimidated by some people's jargon's over the board,no! not after metock.

Much as metock was not about Ofms, it does give some light on the whole issue. Immigration lawyers are still arguing the issue of ukb not considering Ofms and lets optimistic in that case.

thanks OBIE for your advice , i wonder y others have been harsh and giving me wrong informations, The reason is, much as I respect Obie's opinions, he has a more rose-tinted outlook, whereas us seasoned posters mostly are more cynical and jaded and align with the ECO tenet - 'on the balance of prob...

The border control experience differs. I for one, and travelling with my hubby, got a lot of stick from an IO at Brussels midi who was of the opinion that: 1. I needed to complete a landing card and have my passport stamped 2. My RC could be cancelled (by an IO) at any time 3. My rights of residenc...

Besides the UKBA, most co-operates in the UK, have got very few well trained staff. Just grab the phone, speak to the person on the other side of the line, or try to make an inquiry, and you will see what kind of response you will get. Some times it takes five customer service representatives to get...

This the way i understand it then: That if the applicant can prove that he/she has previously stayed with the EEA sponsor in another member state( under the same roof), that applicant could be ok. Thats step N0.1, before other issues into consideration.( such as Valid ID, Being dependant on that sam...

There is no specified time limit set. Although the UK insist the extended family member should have lived with the Union Citizen for about six months in the member state from which the are arriving, in order for the non-EEA national to qualify. I shall forward the guidance if i find it. The directi...

Re: Landing Cards & Arrival Stamps-EEA Resident Card Hol

It surprises me that UK is the only EU nation I know that EEA family members’ living in the UK fills –up Landing Cards and get arrival stamps as well. I am a PR holder and was asked to fill a landing card @ the airport last week and my passport was stamped as well. Does anyone know if this is r...

These are the Court of Appeal Rulings on the construction of Article (3)2 of Directive 2004/38EC. I thought people who are applying on this basis would appreciate this information. 1. KG &AK Prior to Metock 2. Bigia & Ors following Metock. The court and the Secretary of State have conceded that Met...

Pemo, yes you sent a letter explaining UKBA had the Passport with them, did you quote them the Ref. in regarding that very Passport? As quoted, by the OP and Obie, the Directive clearly gives several alternatives to a sititution like this one. On the EEA2 Application forms, UKBA states that if your Passport is with Home office, you should tell them, hence quote the reference .............. .am i right? Furthermore in the case wor...

DFDS, simply having a joint tenancy agreement will not work if both parties are contributing equally to the rent cost. Under the EU directive, the EEA national on whom the non-EEA is dependant, will need to show he/she has primary ownership of the household on which the non-EEA reside. An affidavit...

This conclusive statement is very narrow minded as the alleged forgery and corruption is not limited to third world alone. It is a clear afront to modern world and a false accusation to third world nations. Is it? I disagree. I travel to Russia quite often, not even third-world, a so-called emergin...

If those are the rules then those are the rules I'm afraid. Birth Certificate proves very little especially if from a third-world country where forgery and corruption abound. Try another DNA test? Why was a DNA test requested? What is your country of origin, and what is your age and reason for depe...

Ed, the joint tenancy will show that you live in the same household, but how the rent is paid, and who has primary ownership of the household would also be an important factor and will be taken into consideration, How old is your Brother? The above will cover the situation in the UK, in regards to ...
