The MAC tier 1 report had a graph showing that most under the previous HSMP earned more than £40k when they applied for ilr. The definition they use for highly skilled work is those being paid in the top 10% I.e. about £46k. If you are being paid less than that then you are probably not considered...

It is probably because most responses came from employers or bodies representing employers. They obviously prefer employees tied to them than those that are free to move. MAC responses mostly for cutting tier 1 to protect tier 2

Professor Metcalf, chairman of the MAC, told the Home Affairs Select Committee yesterday that the responses they had received so far for their consultation had mostly suggested cutting tier 1 to protect tier 2.

If you have been here 3 years then TCS will almost certainly be deducting income tax and ni from your gross, and by law they should be giving you payslips with this information. Your employer is required by law to provide an adequate payslip showing gross, deductions and net. They are either failing to do that or the are correctly showing that you are being paid less than it stated on your CoS.

Either way they are breaking the law.

Only about 3% of ICT visas are rejected (as opposed to about 15-20% for other routes), so this is unusual. It is probably just some admin/paperwork problem. Which company is it for?

I think the difference in the numbers is because one includes in country applications and one does not. In country applications are not capped. If the employer is paying correctly and within the rules, then the work permit/visa/CoS should match the actual gross paid. If not then a new CoS needs to be issued at the correct salary.

Report them if they do not pay the correct amount.

Despite the impression the tabloid press give, you can only bring your partner and children. Even when you get ilr, it would be difficult to bring anyone else as a dependent. Plus you should think about health insurance.

Just to clarify, these are entry clearance numbers. So unless psw and ict entry clearance numbers are also capped (which seems unlikely), then extensions may be considered.

I don't think extensions should or will be capped (but for tier 2 general this has already happened as the interim cap is on CoS). Look at the numbers for 2010Q1, if the 2000 psw and 7000 ict visas per quarter are not capped then all the cuts fall on tier 1 general, tier 2 general and dependents. Ev...

I think you need a new CoS for an extension or significant change of employment. So the cut in CoS could result in sponsors being unable to extend tier2 employees. It should be clearer in 2 weeks.
