Re: Naturalisation possible?

The only issue I see creeping in is the possible appearance to the Home Office that he entered into marriages of convenience just to remain in the UK. That could lead to trouble if they decide to look more deeply into the immigration history and make that designation. Yep. That too. If that was the...

Re: Naturalisation possible?

If it were the case that he did not have adequate visa as you said, he got married again to an EEA National in July 2011. This means that the earliest he can apply for naturalization based on good character requirement is in July 2021 if partner was exercising treaty right and not Feb 2022 as you s...

Re: Naturalisation possible?

I do not think so. He did not breach immigration rule simply because he did not get a residence card. Ofcourse not. He simply did not, after the point of refusal and before he remarried and applied again, have a valid visa to remain in the UK. This will be considered against the Good Character requ...

There is no right to a fair trial. This is not a criminal matter. It is an immigration matter and the Home Office has wide discretion on how they handle this.

Re: US girlfriend coming on visa waiver

Thank you for your reply, this is what I was after. Rather than someone just going “it’s not a visit” which I felt wasn’t very helpful at all, Sometimes we tell the truth, even if it is not what posters want to hear. If the Entry Clearance officer decides that 5 months is not a visit (a reasonable ...

Re: Why do the home office need my Ex's Parents passports

The caseworker is not a passport examiner or a citizenship examiner. That is clearly outside his or her scope. Her checks are confined to establishing if a passport is bad quality or genuine. That is the job of HMPO who would have checked before issuing the passport. The Caseworker is not trained o...

Would you be willing to go visit them? Possibly much much simpler, depending on your nationality and visa status in the UK.

Hi Casa,

Thanks. Please note that he had not received the decision on his Tier 1 G ILR. Before he received any decision he varies his application to LR.

Thanks
If the previous application was going to be refused due to tax amendments, LR will likely also be refused for the same reason.

Re: How long can I legally stayafter I let my visa expire?

Given that there is no exit immigration, the authorities will not even be sure whether you have left or stayed or initiate any actions on your eventual departure. Not true any more. The UK does conduct exit checks and they do record exits from the UK depending on how you leave. Essentially, if you ...

No, you are mistakent. A person in the UK on a Fiance visa does not have to leave the UK and can apply for FLR(M) before fiance visa expiry. The Fiance visa is not indefinite (in fact I believe it is only 6 months). Somehow the holder has to regularize their stay. They either leave the UK before ex...
