Marrying someone without divorcing previous partner first can be grounds for marriage annulment, i.e. your marriage will be deemed as never taken place. This might lead to ILR revocation.

The fact that all your appeals were dismissed and you were made to report makes me think that you were considered to be an overstayer up till the moment you were granted ILR. This means your lawful stay would start in August 2008.

I would suggest you seek professional advice.

I would be very careful when trying to enter UK as a visitor. If they learn you have a partner in the UK they may refuse you entry expecting you to enter on FP, at least that's what they do if the partner is british.

Have a look at this 1. It's not a permit. It's a confirmation of your rights of residence in the UK under EU law. You cannot get ILR under EU rules, instead you will be applying for Permanent Residence (PR) using EEA4 form. 2. For the purposes of BC you will be subject to immigration controls until ...

There is no such thing as "naturalisation as a political asylum". Currently there is a long residence concession for illegal immigrants, which requires 14 years of unlawful stay in the UK to qualify for ILR. However, we don't know if this concession will still exist in 1.5 years as the new law enact...

If you can prove that you excercised treaty rights for continuous 6 years (P60s, etc.) you can apply for BC now (no need to send PR card).

Alternatively you can wait 1 year and apply using your PR card, in which case no need to send P60s etc.

It depends on local authority.

Local authority of Brent in London holds 3 ceremonies a week.

As been confirmed by them you don't have to live in Brent to use their NCS to apply for citizenship.

You can't transfer your contributions towards NHS to someone else, even if it's your mother. As you are young most of your NHS contributions will be consumed when you get older.

It's not really fair for a taxpayer to foot the bill for your mother's treatment.

First of all I'm not a registered OISC immigration advisor or solicitor so take whatever I say with a pinch of salt. According to Annex B of British Nationality Act 1981 - caseworking instructions there is some discretion with regards to breach of the immigration laws 8.10 We should normally exercis...

UKBA wants to take it further. There was a consultation paper on pre-entry English requirement for spouses.

On the bright side they were proposing to set this English language requirement quite low (command language level), which if you ask me seems to be quite reasonable.

Just a small thing. As you started work in Aug 2005 your wife should be able to apply for PR in Aug 2010 not Oct 2010. If you can show you were looking for work since July 2005 then she should be able to apply in July 2010. As far as I know under EU rules there is no minimum requirement as to how ma...
