The HO would only confirm your Permanent Residence status on the date of issue following EEA4 application. This on itself would not prevent you from applying for naturalisation when you are eligible (EEA4 is not mandatory for naturalisation). See citizenship FAQ Q1 & Q5 for details (link below).

Him getting PR won't shorten the time for you. It still would be 5 years. But the application would be simpler as you will only need to provide his PR card instead of all the evidence. The correct term under EEA route is PR (Permanent Residence) and not ILR. The time under EEA regulations starts when you become a family member = wedding day, not when your RC was issued. Letter from employer? HMRC employment records (you can call them and ask for it).

For time before divorce (if within the last 5 years), you will need to provide proof of your ex exercising treaty rights throughout that period.

EEA regulations are separate from the UK immigration rules (which Tier-4 falls under). So one should not affect the other and in fact can co-exist.

Slovak RC won't act in lieu of a visa so a EEA Family Permit is recommended. It will also make your husband application once in the UK simpler.

You covered all the bases so should be fine to apply in February.

It is difficult to give you advice given that you ignored the advice we gave you last time about ILR.

You took a risk which didn't pay out. Your options are:

* Reconsideration (£80), if that fails,
* Sort out their ILR (more complex now that their visa expired) and re-apply.

Presumably they had as part of the 2 year visitor visa to prove they are economically independant and have strong ties to their home country. That would be used against any claim they have now that they are dependant.

PR status is obtained automatically after exercising treaty rights for 5 continuous years and is independant from your status. You can't use the EEA regulations if you are not EEA national. RoR just means you retain your right of residence. Nothing else.
