Re: travelling to france with expired family permit

You will need a passport for the little one. A birth certificate is not enough. Strictly speaking a visa is not required although might be easier to get a schengen visa (if required).

Leave blank. Those questions are in case you don't have a document certifying PR.

Re: EEA family permit - trouble with online form

If I were you, I would just skip the application and get the stamp at the border. Would be quicker and saves you all the forms (and trip to the consulate). See Q1 in the FAQ (link below).

Once in the UK, she can apply for a 5 years Residence Card.

Re: Naturalization of family member of EEA national

Please note that there is a difference between obtaining PR status (that happened automatically after 5 years if married to EEA national exercising treaty rights) and obtaining PR card (following an application). The former is the date that matters. See Q1, Q5 & Q6 in the FAQ (link below) for more d...

If you have a document certifying Permanent Residence following EEA3 application, and this was issued more than 1 year ago, then you can skip 2.4-2.6

Re: MN1 - Registration of a child from overseas

Are you British from birth? Were you born in the UK? Unlike Australia, the UK doesn't require British citizens (from birth) to register to obtain their citizenship. It is granted automatically (to children born abroad to British citizen not by decent)

Re: With which document back to UK after ask passport back E

The problem is not getting into the UK (the CoA would do that job) but to get the border. If you drive from Paris, you should be fine. Most people asking for a passport either have a valid Family Permit or dont need a visa for the UK.

Re: With which document back to UK after ask passport back E

Are you a visa national? Then you will either need a RC, EEA Family Permit or travel by land (as airline will not let you board without a visa). If you are not a visa national, the CoA would be enough to get you in. The A4 ISD is what you will get when a decision is made and the HO doesn't have your...

Re: ILR application - is my 5 year period complete?

Under EEA Regulations this is called Permanent Residence (PR) not ILR (which is under the UK immigration rules). You have obtained PR status automatically after 5 years (Nov 2014) if your wife has been working for 5 continuous years. See the FAQ for more details.

Re: EEA citizen but permanent residency broken for 13 months

Thank you for the replies - this is very helpful. I didn't have a passport when I first came in 1998, only a French ID card. There was no need for a VISA, coming from a EU country so I don't have any record of any date of entry. However, I do have pay slips and P60s dating back to this period as I ...

No. Treaty rights are not needed after PR or ILR.

After ILR you are not dependant anymore.

Re: EU Treaty Rights after obtaining PR card

You need to prove you meet the residence requirements for the full 5 years (before the application) when applying for naturalisation. Not only the time since you achieved PR (requirements for PR and naturalisation are different). Normally a passport is all that is needed to prove residency for natur...

Once you obtain PR (after 5 continuous years of exercising treaty rights), there is no more need to exercise treaty rights.

It counts if you have applied at the time as unmarried partner of EEA national. If you just have been on visa student, then it doesn't count.

I would be careful you use that lawyer as he doesn't seem to be familiar with EU rules. If you can't qualify for PR under the EU rules, you won't be able to qualify for ILR under the 10 years rules.

Alternatively, you can apply for a CoE-RoA in their Indian passport. That will allow them to retain their Indian passport until the age...

From the sounds of it, the case worker made a mistake. I would apply for reconsideration (there is a fee attached but I would ask for that to be refunded as well).
