u r eligible on 26 sep for ILR ................if ur 28 days overstay finish on 23 aug n u apply say 20 aug ....n den hv 15 working days for bio n do it on 13th or 14th n by da tym it reach caseworker desk it wuld be well over 26 sep .....jus make sure everything is complete I terms of application.....

u can go for PhD if u manage to get a CAS.......other option wuld be to apply for FLR (FP) n den delay the biometrics which could buy u 2 - 4 months.

Due to double rejection u r overstayer from 30/04/08 until the LTR was granted on 30/07/08 almost three months....ur LR could be broken n it is solely on the basis of discretion for succeeding on the 10 yr LR basis.

You can still do a masters if you hv previously studied at a university and the limit is set to 6 yrs.For PhD there is a maximum limit of 8 yrs which is in addition to 5 yr cap.U can read the Tier 4 caseworker guidance for more info.jus search in google.

first of all universities are extremely cautious abt immigration rules and they don't even give a benefit of doubt to international students that's y whn dey find out u didn't enrol dey informed HO straightaway. there is no immediate threat to 10 yr lawful residence due to being tied to Human Rights Act 1998.
