Joh118, The statement you responded to was ''one partner is a non EEA national who's without leave to remain'' not both parents. You only need one parent with a settled status for a child to qualify as a BC. yes...I am very aware of the rules. what is your point? This is my point how could you poss...

Thanks for the reply. I would like to know on which protocol of Judicial Review (JR) that won't allow when an appeal is in a process. Your answer is right here . ''Normally the court will not hear a case unless satisfied that all statutory remedies open to the applicant have first been exhausted . ...

If you have a right of appeal, which I know you'll get from spouse visa. Like Vinny advised, pursue the appeal, I dont think you can have a JR unless if you have no right of appeal in the initial application.

I was wondering what is the docs checklist for going home and re-applying for a spouse visa as that is from my opinion my best chance of sorting this out. Can anyone help? It's the best option, but in your case, absconding and any criminal record (you didn't mention the extent of the driving issue)...

I also agree with Greenie's argument. Go home doesn't work in all cases, so it shouldn't be a generic advice. Go home advice should be given based on individual facts. It's funny how people refer to all the successful stories from abroad and not one of the refusals (loads on this forum) based on rid...

even if you are granted a CoA (unlikely, in my opinion), you will still be unable to marry in the UK (with no legal permission to remain in the UK). Sushdmehta, I dont think the above statement is correct as far as I know. The registry only request for your leave to remain or permission from the Se...

Good luck.

if one remembers the failed asylum seeker that killed a 12 year old girl with his car which prompted the distraught father to say that his daughter would still be alive if he had been deported. The argument could also be constructed in the opposite direction, that these children's future and welfare should not be held to ransom because of their parents actions, or the desires of UKBA to punish their parents. Looking at it from proportionality point of view, is it proportional to punish a ...

Re: Can I get married in the UK without a fiancee visa?

If I were to marry him do I need to apply for a fiancee visa from Canada, then marry him, leave, then apply for a spouse visa? Yes but you dont need to return to Canada. To marry him in the UK without a fiancee visa, you'll need to apply for a COA(CoA will be abolished soon but its not been announc...

Re: Experience with INCOMPETENT Border Control at Heathrow T

I would also question why home office treats EEA citizen first class citizens? Why they dont have to pay visa fees for their applications. This is clearly discrimination and injustice in UK system. Lets not take this to another level. The EU directive prohibits fees for EEA applications, not just i...

I read the OP's post the first day it was posted but decided not to comment because the first few responses was clearly focused on the OP's personal and none was ''constructive'' I was surprised today to see how far the thread's gone. I emphatised with the OP because I could feel the anger of someon...
