You'll still need to satisfy the maintenance test. You need to show that you can both be maintained without recourse to public funds. At the moment, you £5000 overdrawn and your company statement is not much of a help either.

So a lot still need to be done mate.

You might need to go through this as well. and also have a look at what's in paragraph 6A-6Cas suggested to you before.

All that needs to be properly considered before submitting an application.

I also think that could mean he's claiming additional benefits on behalf of the wife who is excluded from public funds. Just a thought.

Whatever you need to do, bear in mind that you are not allowed to stay out of the Uk for over 2 years. That's why Casa was asking how long you've been out of the UK.

Thats how funny the HO could be. I have heard of cases where they advised the applicants to withraw cases from the court for reconsideration and they still end not being granted.

It's best to rely on the court as you have done, and do not withdraw your case unless visa is issued.

I know you can travel out of the UK with an Emergency Travel Certificate(ETA) but that could alert the IO's at the airport to ask questions. Having said that, I think its worth waiting for or seek expert solicitor's advice, they may write to the HO regarding your application.

I think you only need photocopies of document to support your appeal anyway. They wont ask for the originals.
