Unless child's other parent is dead Thats not correct, its only one of the evidence of sole responsibity. In Nigeria, fathers have more parental rights than mothers (dunno if the OP is a man or woman), it may sound weird but true, the OP knows that. The child's already living with the OP's parents ...

Thats not part of the immigration rules but I agree with the rest. You need evidence to show the child in question is living with your own relatives and not the other parent's relatives and you are directly responsible for his or her upkeep.

I think it was an error of judgement to have withdrawn money out of the account for tickets, when visas hasn't been granted. Could have waited until the statement was printed and sent to the embassy before taking money out. I 'll go with Batleykhan's advice, its the best way unless you want to wait ...

Thanks Wanderer for your response. We discussed more about it today and realised that language could be a barrier in Spain, Germany and Austria. We have decided on Dublin (Ireland) as a prefered option. I 've also got a few friends as well living in Dublin who can help us settle quickly. Like I said...

NON-EU MOVING OUT OF THE UK TO EUROPE WITH A BC PARTNER

My Story I have been in the UK for 5 years (no leave to remain), I have a BC partner and a 10 months old BC son, we have lived together for almost 2 years (20 months precisely and have all documentary evidence). Spouse visa is not for me as my partner is still under 21. I have made a DL application...

I think the ECO got it really wrong. Para 320(7B) should not apply to you as a result of your overstaying in the UK. I believe you've got a very good chance on appeal, I also believe the ECM should overturn the decision if he's to do his job properly.

Good luck mate.

This is a quick update. I have sent joint sponsorship together. The family visitor visa has been approved for 6 months even though we applied for 4 months. Thanks to every one for their time. You will be issued a visa for 6 months even if you applied for one week. Visit visa starts from 6 months, m...

New PBS appeal success (In the Court of Appeal)

The appeal against the Home Office interpretation of the Points Based System has succeeded in the Court of Appeal. This new judgement might help anyone in trouble with the PBS £800 for three months requirements. It also favoured applicants article 8 rights. Section 37, 38, 39, 45 and 46 are importa...

Why not get married to your new woman, if thats an option and apply for a spouse visa again and I think you should seek immigration expert advice as well.

Is your first spouse visa expired?

HRY2005 , The OP's husband's savings will be taken into account, because as djb123 says, it is the couple's ability to support themselves that is at issue. It's not really comparable to accommodation because money is portable; a home generally isn't. The Immigration Rules themselves state: (v) the ...

If you are adopted by British parents, you are treated as their biological child as well, what about your adoption certificate? You allowed to use that as evidence of your rights to live and work in the UK.

Re: please advise...to all you great minds -settlement visa

No the ECO wouldn't - the actual requirements says "you can support yourselves and any dependants without any help from public funds", it doesn't say the sponsor has to support the applicant. By sponsor it doesn't necessarily mean financial sponsor. (The application form actually asks for savings h...

Re: please advise...to all you great minds -settlement visa

Your husband's money might help but not really important because you are the sponsor, you need to prove your fitness in sponsoring your husband to the UK. That's not true as they are a couple, so what is his is hers (but not usually the other way round...). I agree with you but the ECO would not be...

Arrh yes, but when after they return to the UK? The only way of making the twins British will be for an application for Registration to be made, when one or both of the parents applies for Naturalisation, or later, when one or both parents is already British. As you both have ILR and only in India for 6 months, your twins would definately be British citizens after your return to the UK. I really dont think there's any difference, it's a question when? Unless you never returned to the UK in 2 years on your ILR.

Someone should correct me if I'm wrong

definently you can invite your parents for short period like 3 months or less. you need to write saying to spend holiday in london with you, during their stay you will take care of their accomdation and expenses. I support that opinion. A lot of people get visa for no big reasons than sight-seeing ...

Still wondering why the restaurant/accountant had the NI number in the first place if they didn't think they were were employing the OP. The OP needs to tell the truth. No need to supply NI to someone if you are only helping "sometimes when my Dad best friend's wife is away" and the accountant paid...
