For Tier 1 holders, it is not mandatory to have employer letter, however as mentioned, it is advantageous to obtain one, as an additional evidance of your work with the company.

Because when people have continuous leave that falls short of five years due to late arrival, they are permitted to include the period from the time the visa was issued to the end of the five year period into the sum. You complete 5 years on 3rd Dec 2011. 28 days before that is 5 nov 2011. Your visa expires 9 nov 2011. So you can apply on 7th/8th or 9th nove (5th and 6th are weekends). You have enough leave to apply so u can not ask for 90 days descretion.
