Your husband has PPS No. you can declare in revenue that you are married and claim his credits. Your husband's visa status is none of their concern. For EU treaty rights, I would recommend Brophy Solicitors.

I have also heard Synott Solicitors are good but have not dealt with them for EU treaty rights.

The Directive says the Health insurance is mandatory for residence permit application under the EU treaty. Correct me if I am wrong. Tax credits and spouse with no permission to remain?

Hi all, After much googling, I could not find an answer so thought someone here might know. Does anyone know if I can claim my husband's tax credits while he has no current permission to remain and is not allowed to work (spouse of Irish national application with INIS)? Any help is much appreciated.

Also, you will need to have sufficient funds to support both of you and not to be a burden on the State. If the Minister for Justice believes you will need to rely on social welfare or public funds to support both of you, he will refuse the application.
