Also, I am just thinking that the EU spouses should plan a peacefully protest at the immigration office. Protest against the stamp 3 issuance to their spouse. I think they have right for this If you are organising this, please tell me when and me and my partner will love to go. Perhaps though, it m...

Until the DoJ withdraws this intention to issue Stamp 3, my suggestion to any non-EEA national family member (§ 2(2)) who applies for a Residence Card is to proceed as follows: Remind the DoJ on submission of the EU1 application that the DoJ is obligated under § 10(1) of Directive 2004/38/EC to i...

Once you were married to your wife for 3 years or more and have documentary evidence to prove that and to prove that she was exercising her treaty rights, then you can retain the right of residence in your own right. Also in order to retain the right of residence on your own under the directive, you...

Hi guys, Was talking to my solicitor today and she said that even the people who are already on a temporary stamp 4, will have to change to a temporary stamp 3 (on the 1st June) until their application is processed. I think this is highly unfair. In my partners (non-eu) case, I think he is most defi...

Thanks Ben.

Yeah thats what I thought about the Permanent Residence Certificate, that I do not have to fill all the requirements although my solicitor told me different.

Will just keep the fingers crossed and hope they issue us with an acknowledgement letter next week with a temp stamp 4.

I've sent this open letter to the Department of Justice, and a similar one to the European Commission: Dear Sirs, In July 2008 I contacted the European Commission and made a formal complaint in relation to several breaches by the Irish government of EU Directive 2004/38/EC. Since then, there have b...

Hi guys, What do you think about this new info from DOJ? Do you think EU will force them to revoke that decision? We just applied (me and my unmarried partner) last week and have not received acknowledgement letter yet. Really hope he receives temp stamp 4 because we cannot survive on one salary. Do...

If the DoJ's intention is to restrict people from working until their EU1 application is approved, why don't they just issue nothing for the six months? No breach of the Directive would occur and it wouldn't get peoples' backs up like the issuance of Stamp 3 does, which, incidentally, is in breach ...

It is very important that you advise the Dept IN WRITING, ASAP that your wife is no longer working. Why? I think because in Irelands regulations they state that you MUST notify them of any change in circumstances, be it a change of address or if the EU citizen has ceased and/or entered new employme...

An unreasonable burden on the state I would think would be seen as taking social welfare (jobseekers allowance and/or rent allowance) for a long period of time, lets say more than 9 months to a year and also not intending to look for a job at all which is what you need to be doing to be still exerci...

How long was your wife been working here? If less than 1 year, and she was let go, then she has a 6 month lee-way of looking for a job and has to register with FAS as a jobseeker and send DOJ the letter of registration. If she is working here more than a year, it doesnt matter that she has been let ...

Was a good seminar, although I knew most of the stuff from all the knowledgable people on this and from the internet. My solicitor told me (Guru's feel free to correct me) that if you are spouse/partner/family member of an EU Citizen and have obtained stamp 4EUFAM, after 3 years you are safe. You have obtained residency rights after 3 years and it does not matter what the activities of the EU Citizen is after the 3...

One can apply for Citizenship, after 5 years of legal residence in Ireland and without any criminal convictions or any burden on social welfare. Note it can take 3 ...

If the op was saying, eg 2 years relationship with at least 1 year - 1 1/2 years co habiting and maybe eg a child, then my fears would not arise But one could argue that time spent in a relationship, not living together, was still in a durable relationship. Just because we didnt rush into living to...
