Is the application refused or just referred to more senior officer who has the authority to give discretion? This seems to me that because the case is not straightforward, they need to escalate this to more senior officer for consideration of discretion. That's why the keep your passport and document.

In theory your Tier-2 is invalid once you are made redundant, If I remember correctly there is 90 days grace period for you to get new visa, but in your case it is more than that, therefore it is considered as break of residence.

I personally was in this situation, and decided to switch to Tier-1. Looking at the uncertainty with the Immigration rules. I think it would be sensible to switch to Tier-1 as soon as you qualified.

It will cost your friend quite significant amount of money, but I guess it is worth it.
