From what I know, when one applies, upon receiving the application, they place a stamp on the page where the Schengen visa should go (if I remember correctly). If it is rejected, they normally don't just give it back saying it's incomplete, they simply reject it. I will be honestly surprised if they...

mcovet, I think once you have paid you loose your leverage (unless you are willing to sue). They issue the visa and can say "Frau Evil's freedom of movmement is not being interfered with, so lets move on". Especially if the visa is really optional, as in this case. WRONG, the payment is, if anythin...

the problem is that you have the PR sticker which does not say "family member" etc. but I presume your RC is still in the passport? Then you only show this at the border and travel without the visa with the marriage certificate. And on a practical note, there isn't much anyone can do against a forei...

the point Jambo is making is that having been away for 360 days, even if you wait another year to avoid the 90-days absence, what about the previous 4 years dating back to August 2008? Were you out of the country for less than 100 days between August 2008 and August 2011? If yes, then you qualify, i...

you are ok with most UK insurers, that is a grey area so as long as there is some insurance you are fine! as regards the studies, why are you so concerned about the course? it is not the course which makes her a qualified person but rather the CSI during the studies and sufficient funds, which are t...

ok, unless you have an adverse immigration history and the marriage followed a recent visa refusal etc. all you have to submit is the following: 1. your EEA national's ID/passport; 2. proof of her exercising treaty rights (letter from employer, 3 recent payslips, contract of employment etc.) (if not...

Re: Kindly help !!!

Hope someone will correct me if I'm wrong: 1. My partner is pregnant & she is on maternity leave. I would like to know for how long she can be on maternity leave? http://www.adviceguide.org.uk/england/work_e/work_time_off_work_e/maternity_leave.htm gives a good idea about it. I regard a woman on a m...

doubt the UKBA has any way of checking you are out of the UK on that Monday/Tuesday they receive your papers. Have NEVER heard of anyone having that problem so it may simply be a quirk of the law which isn't enforced in practice. The bit with you being in the UK 3-5 years before your application is ...

if your unmarried partner has a RC then you could be able to travel together as one Member State recognised your relationship and you have a point to argue at the border. If your partner does NOT have a RC issued and he is in the UK in a different category, I doubt the border police on the French si...

how about you pay the £16 but under protest and then keep claiming the illegality the way you are now? Sometimes in life you have to be more tactically aware. The embassy don't care whether or not you make a point, now, later or never. So, pay the £16 service charge and then claim it back. If the Ge...

jambo's answer pretty much says it all. it is annoying to say the least to see you acting so thick. anyway, if I were you, I would still go for the NCS appointment as they only take copies of all your documents and in all likelihood will ignore your lamination. Therefore, when the UKBA get your application, it will show copies of your mar...

The regulations are quite clear. To qualify as an extended family member (OFM) dependency or household membership must be shown in the country from which the person came. To obtain a RC as an OFM you must first be an OFM which is an almost de facto state if family permit has been obtained. Sneaking...

1) no difference how they came to the UK, even if in a bath tub over the Channel, so long as they qualify for residence once here. In only VERY VERY limited circumstances can illegality cause a refusal and that is in cases of public health and safety matters etc. which is clearly not the case in 99....

Why would your lawyer possibly lie to you? Obviously she wouldn't at all. I was wrong to think that, she is a good woman, so ok then why the HO representing officers tell me that and then after me she call my lawyer and tell her different story!!!(to convince me not to go to court as I will lose an...
