Re: EU FAMILY PERMIT FOR PARENTS OF NON EU FAMILY MEMBER

You see, this is a grey area as I see it. For your parents to come to the UK for free using EEA FP route (form VAF5), they should be regarded as your family members. For that they need to be parents BUT + DEPENDENT on you/your EEA national spouse. Now, if they are NOT dependent on you, they cannot b...

Hi, I see no reason why you cannot apply on form EEA2 if you provide all the relevant info, plus you'd be able to obtain a Certificate of Application which would state you are able to work while your passport is at the UKBA, so your employer won't give you trouble. Thanks a lot Mcovet!! It's a shame...

Re: Rehabilitation of offenders act / EEA2

I think rehabilitation of offenders has 5 years for an offence to be spent, and there are different scales etc? But, the main thing is that under EU law, you are NOT subject to immigration control, many people don't understand that! An immigration officer or any UKBA official cannot do anything, the...

Re: i have 2 muslim wives eea national and non eea national

A) Are YOU a holder of an EEA residence card since 2005 or you ARE an EEA national yourself and if yes, it shouldn't be a problem. How did you obtain the EEA family permit for your 2nd wife? based on YOUR relationship as the EEA national? If yes, then again you shouldn't have any problems obtaining...

Re: clarification please

Sorry, I know it seems confusing :) you get PR on the basis of (briefly discarding the EEA's requirement to exercise Treaty Rights for the 5 years you live together): 1) Having resided with the EEA for 5 years; 2) That joint residence should be "in accordance with the "EU Law" i.e. being a family me...

Re: EEA4 on 5-year relationship but 4-year Marriage

UPDATE: Please see UKBA Reply http://immigrationboards.com/viewtopic.php?t=68425 Hi, what status had you been on before you married your EEA? Was it work, student etc? and was this relationship in the UK for 5 years? If yes, I also don't see any reason why it shouldn't work. The regulations say unde...

I know of a case for sure, parents came on tourist visas, stayed in the UK and successfully applied for RC! while the application is pending, simply try and obtain some proof of address, i.e. add them on council tax, phone bill, gas bill, ANYTH. even though not strictly necessary. A covering letter ...

Did they come on an EEA FP? If so, this would only have been issued if they are dependent on you, thus, if issued you can apply for EEA Residence Cards for them now and send exactly the same docs as when applying for FP in their home country! If they weren't dependent on you, they'd need to have app...

Re: 10 years legal stay leading to ILR

that's right, the 10-year rule doesn't seem to be a threshhold. What is so specific about 10 years which creates "family life". A person could have established such family life in less than 10 years, so to the guy so nervous about abolition of the 10-year rule, they may well do abolish this route! I...

Why hasn't anyone considered Surindher Singh? Happy Diwali :) technically, the BC has exercised the right to free movement and can benefit from it! There is no EXPRESS provision in the legislation and it would be up to the courts to interpret the spirit and the word of it, however, it would seem pre...

She needs to be wholly or mainly financially dependent on the EEA national. Your brother's support could take her out of the realm of the EEA's support and into the hands of the national law. Others may give you more advice. Can't you only note your support? Dear Friends I am applying for my mothers...

God, you're nosey  as I said this is a hypothetical question. Let's assume one is from his/hers native country where they lose their British Passport. If they have their native passport with the ILR in it, it would be quicker to fly back to the UK and apply for a replacement here, rather than a...

Thanks for the reply! What's AIVI? Have you got statutory authority for your comments? Many thanks again. AIUI - as soon as you are a naturalised BC - the ILR is no longer valid (because you are a BC) and thus couldn't be transferred. But this begs the question - why would you want to keep the ILR s...

Re: CAN EU ROUTE WORK FOR MY HUSBAND WITH PREV DECEPTION?

You are right to love SS! you are spot on to get your husband to the UK this way, once you prove you benefit from the EU free movement Directive, which you would, the UK cannot stop you and refuse to let your husband in. The only exception is if he represents a current threat to the public etc. whic...

What happens to ILR sticker after Naturalisation? Thanks

What happens to the ILR sticker in a foreign passport after obtaining a British Passport? How does it work in general, could you enter the UK without even showing the British Passport (obviously in theory) and is ILR valid nevertheless? If it's still valid, can it be transferred to a new foreign pas...

Just another query. Family Visitor Visa, possible Art.8 ECHR. Pls Help

Now, it's a bit complicated because the father of t...

my question relates to the fact that if an EEA national received a Document Certifying PR, based on the fact that he/she had exercised the rights for 5 years, the PR sticker should suffice instead of the pile of documents.
