do not panick. What grounds is he basing his divorce on? It is not that easy to divorce for him if you do not wish to!!! And please ensure you seek legal advice on how to obtain financial provision from him upon divorce. By the time the divorce is finished, you will be nearer to the 3-year mark requ...

May 2011 is not significant in ANY respect! WRS scheme was not that difficult to register with as was not capped or prohibitively designed. So, nothing is going to be different from May 2011! If it had been similar to the transitional arrangement for the Romanian/Bulgarians- that would have been a d...

It seems as someone already suggested that u guys are paying for those who settle and then suck the system which costs more to uk govt. So they try to take at least some back its understandable. Its the last one off fee for ppl to settle so start saving now.

Good point about the arrangement but it's more of a discrimination thing which the Directive expressly attempts to eradicate. U cannot ask an eea national/non-eea fam memb to do anyth which u wouldnt ask the brits. As regards the cards, many people who have requested their files through SAR have sai...

And only after that ur non-eea can work too So, just get a job for a m...

Technically, u COULD get away with only showing she was exercising treaty rights from the start of the divorce to its completion, but because she is outside uk it would be hard, from the info u provided, ur case is diffucult as ur wife left uk and divorce petition would be bad proof against u. 10-year old son visiting NATURALISED political refugee in UK

Hi, There is a divorced political refugee (the "Guy") who naturalised in the UK after fleeing Russia some 7 years ago. He has a son (8 years young) in Moscow who he only sees when the mother (whom he divorced) with the son get a visitor visa to the UK (once so far). Now, there is no way the Guy will...

Interrelationship between EC Reg 1612/68 and Directive 2004

Hey, anyone has any ideas how does Directive 2004 affect the Regulation 1612? I know that the Directive repealed most of old law and just amended Regulation 1612 in part. What can the EEA citizen rely on as a worker? Directive 2004 or Regulation 1612 or both? Reg 1612 has extensive case law, would t...

Thanks, so you also see a bit of contradiction between Art.14 and 24(2), preamble 21. What is the relation between Old EC Regulation 1612/68 and Directive 2004/38. I know the Directive repealed others, but only amended this Reg. If so, Antonissen could be good ground to rely on under that old Regula...

Could the "social assistance" referred to in the Directive NOT refer to the JSA income based but other benefits (such as Housing, Council tax, Income Support etc)? This would make sense if a Job seeker was treated the same way as the UK national with respect to being supported.

thanks for the reference. Article 14(1) is confusing "1. No, I think after the three months (or even upon entry) the EEA citizen who can prove that he is a job-seeker (thus a qualified person) is entitled to it, unless he has no genuine chance of finding employment! just kidding, you're fine until you have been convicted in a court of something, declared bankrupt (for this the creditor must issue a statutory demand, pay the fee etc.) you're safe don't worry, but pay it anyway, I can give you 4 quid if you want.

Yes, it WILL, just pay the £4 and sleep safe... don't forget to cancel the service though and look out for other unknown debts which might haunt you. Hello, I signed a NTL broadband contract in 2006 for 12m. B4 finishing the contract(abt 8m), I have to move to halifax. I called them up and finally ...

Re: Timelines for Citizenship

Because you are only entitled to ILR when your application has been approved (as in theory it may be refused), your one year will start counting from the date of the ILR stamp and not when you first COULD HAVE applied. Good luck! I would like to understand the timelines to be eligible for attaining ...

Ok, you are right on one hand. You need to find out whether for your wife to initiate divorce proceedings from abroad she needs to have been resident or domiciled there. If so, find out if she had lied when petitioning there, otherwise the court here would assume that if she managed to issue the pro...

You are french and as long as you live and work in the UK, your wife is allowed to stay in the UK also. This is regardless of the fact that you are separated. Separation is not the same as divorce! For her to lose the right to reside here either you need to leave the UK for over six months or you ne...

Larswell, what do you do? You only need health insurance if you are NOT working! If you are, then you do NOT need health insurance. If you feel you will lose your job or want to leave the job, then before you do so, just get the health insurance. Otherwise, no need for it, noone will ask you for it....

Re: non-eea ex-family member applying for permanent residenc

It's 5 years of living "in accordance with the 2006 Regulations" (I think it's Reg 15). So, Jan 2012, provided you can prove that you actually did retain right of residence (i.e. your EEA was living and exercising treaty rights from the time you initiated the divorce until the decree absolute). The ...

Re: US married to EU living in UK - need advice

My immediate Q is: do you eventually want a European passport? If this is so, you should stick with your work permit as you are only 2 years away from obtaining ILR (mind you, the rules may change). This does not stop you from also taking the advantage of the EU route and apply for a residence card ...
