you are right, threaten them with legal action in writing! and if they fail to respond within 21 days, issue a claim in a county court on form N1 I think. It is straightforward, but when they see you mean business they will process your application.

a bit of misunderstanding between you twos. I doubt he has PR confirmed on paper, so first of all he'd need that to make life easier. Once he gets that document certifying permanent residence on form EEA3, then in accordance with Regulation 14(2) of the 2006 Regs, his wife can stay here...forever. S...

it's a good idea to get the citizenship. however, even without it, once you obtain proof of PR noone can kick you out of the country at all, so the advantages of naturalisation are minimal. Noone can adopt a retrospective law saying those people who obtained PR under EU law would now have to leave. ...

Refer them to Regulation14(2) of the Immigration (EEA) Regulations 2006 Extended right of residence 14(2)A family member of a qualified person residing in the United Kingdom under paragraph (1...

Anyway, I should have ignored it, but I just don't like people living throwing stones while themselves l...

it certainly is possible. If anything, that other RC would be of great help to you as that would entitle you to the EU law to apply to you as a British Citizen taking advantage of the Directive 2004/38 and coming back (don't remember the case name, I think Surinder Singh). From a legal point of view...

Congratulations. As regards complaining, not many people will have a cause to complain within the first 6 months. So, in a way, you are "lucky" they mishandled your case. Most people dont even hear from the UKBA so nothing to complain about. What was the reason for the refusal and when was the EEA3 ...

MelC, for PR as EUSmiles said, you need to have been legal for 5 years, registration with WRS was the ONLY way someone could have worked legally, thus having worked in breach of the WRS conditions, the period mustn't be counted and the employer should be fined for employing/not following correct pro...

You absolutely should apply, the process will take the usual 3-6months but at the end of it you will get another RC but ensure it is accompanied by the correct letter, which states clearly you have retained right of residence! This letter will not only help you to travel less hassled but also assist...

You need to have been married for 3 years in total BEFORE she or yourself (I don't think you would initiate this yourself) initiates the divorce proceedings. This means before she goes to court, fills out a form (called a petition for divorce) and serves it on you. This is the point in time by which...

bluecole2 you should keep you answers to those addressing relevant questions ONLY! So, if they ask you are you working, you can say that you derive your rights from your EEA family member who is working herself/himself. If they ask you questions about your fam member then again, it depends if questi...
