If you have been charged and convicted you need to declare on the application form as you risk refusal for non-declaration. However if this was your first offence you normally should have been only cautioned hence disclosure is not necessary.

Easy option is to go straight for ILR as you can apply 1 month before your 10 yrs (ie 9 yrs 11 month) since your friend came to uk in Jan 2003 and has visa till Dec (Assuming end of DEC) he should apply for his ILR under 10 year Rule.
