You are right money doesn't necessarily have to be in the a/c but UKBA can refuse the application on the ground of deception that the said a/c has no funds or worse that it had been closed down.

If you have been charged and convicted you need to declare on the application form as you risk refusal for non-declaration. However if this was your first offence you normally should have been only cautioned hence disclosure is not necessary.
