Re: Tier-2 Visa Cancellation

Are you sure you read the leaflet correctly?

You are not supposed to do send anything in if you lose your job, as far as I am aware. Your can still stay in the country for 60 days to look for a new job which would be difficult without your passport and BRP.

The BRP is just a standalone replacement for a vignette that you get in your passport when applying out of country. It does not need a special mention.

Re: Are we eligible to take up any contract offer?

To add to the uk121's excellent answer, there is usually additional paperwork that the sponsor will require you and the client to sign, to make it look more like a proper service delivery rather than umbrella, and the client must be aware that UKBA can visit them on-site to check that up. This does ...

Re: Promotion under Tier 2

I think you may or may not need a new visa because of your promotion, depending on your duties. Read official Tier 2 policy guidances. If you change jobs, a new RLMT will be necessary unless the role in the shortage occupation list. Regarding lowrt salaries, yes it does happen, but I think not on a ...

No. When the sponsor changes, so must your visa. You will have to start the process from scratch, unfortunately.

Re: help with change of employment dates

I would suggest to be patient and just wait until your new visa is approved. What if your new sponsor's license is suspended, or there is a mistake in the application on their part, or your position new is made redundand? You don't want to have already resigned and your current leave curtailed when ...

1. "Unrestricted"
2. It be a new visa (and visa fees). It will be issued for next 3 or 5 years.
3. You need to apply for new visa for dependents also
4. You shoud wait before new visa is issued AND your notice period is over. New CoS start data should reflect that.
5. No.
6. Depends. Not sure.

Re: Can I register consultancy company during Tier 2 General

I believe the guidance stipulates that the employment should be permanent, but how HO interprets this is anyone's guess. I would play it safe and make it just that - in the same business or via umbrella company.

Re: Lead time for premium service

Are you sure you CAN and WANT to switch from T2G to T2ICT? Even if it is possible (which I doubt), you'll lose ILR elegibility. The lead time varies a lot. I looked earlier this week for slots on 14th of May at Croydon and many were available. If money is not a problem you can usually get one next o...

1 are 2 answered in UKBA official Tier 2 guidance, make sure to check both sponsor and migrant versions. 3 - yes, you will be issued a BRP. It takes from a few days to a few weeks to arrive, but I believe you can start working before that if the CoS allows.

What happens if I apply for < Tier 2 General with a new sponsor via same-day service, but I am still working for the old sponsor?
I want to resign immediately once my new application is approved, but not before. Is that possible?

Re: Can I register consultancy company during Tier 2 General

You cannot do it yourself. But you should be able to contract via an umbrella company if they hire you as permanent part-time employee and you work outside of your main working hours. See "Supplementary Employment" in Tier 2 guidance. Regarding your wife I'm not sure, but I knew a Tier 4 dependant w...

Re: Does change of passport affect Tier 2 extension?

In my experience UKBA doesn't care much about passports. They rely on the information about you that they themselves collected. In your case I would get the extension with the Ukrainian passport, if that is possible. You will have your new visa separately on a plastic card, and should be able to use...

I'm no lawyer, but I think that payroll is the employer's responsibility, not yours, and hence shouldn't affect your rights. If your employment has not been legally terminated, I wouldn't worry about it too much.

I've spoken to a solicitor about a similar situation and they said NOT to wait for the letter and consider your leave to be curtailed 60 days from when your employer notifies UKBA. In my case, the letter never came.

Re: Lost job on tier 2 (general) visa

Regarding advertising the job before they can sponsor you, you are right. But often they will already have run a suitable job ad for long enough, so it can be used immediately. It makes good sense for you to book a PEO appointment for a new Tier 2 in advance, so you can start on the new job quickly....
